FINDINGS OF FACT Property Owners: Violet Sawukaytis and Jason Turner 746 Lullwater Drive Oviedo, Florida 32765-8500 Applicant: Jason Turner 746 Lullwater Drive Oviedo, Florida 32765-8500 (Legal counsel Michael Patrick Nordman of DeLand appeared). Project: Approval of the HPB for after -the -fact permitting/code enforcement related alterations with regard to property located at 300 East 2nd Street. Requested Development Approval: The Applicant requested approval of the HPB for after -the -fact permitting/code enforcement related alterations with regard to property II]'a"e r 1 located at 300 East 2nd Street. Additional Findings: The project is a one story masonry building constructed in 1948 as the Thrifty Service Station (Spur Gas) located at 300 East 2nd Street in the Downtown Commercial Historic District. The building has been substantially altered, including approval in 2016 to remove smooth stucco to reveal the concrete finish seen today. The applicant is requesting after the fact approval to introduce a new door opening and metal door on the rear (east) elevation. The subject property is currently, as has been, involved in code enforcement processes and procedures of the City. The introduction of the door opening does not negatively impact the architectural integrity of the property and isn't visible from primary streets. Metal doors have been approved for secondary entrances throughout the Downtown Historic District. However the style of the paneled door, that was proposed, was not appropriate to the style of the CONCLUSIONS OF LAW (a). Pursuant to Section 8.0 of Schedule "S" of the City's Land Development Regulations (LDRs), the HPB has reviewed the proposed (as modified) Certificate of Appropriateness and all application documentation and matters relating thereto in accordance with the procedures for altering historic landmarks or structures within historic districts as set forth in Schedule "S" of the City's LDRs. (b). Specifically, Schedule "S" of the City's LDRs provides as follows: (1). Only when the change is appropriate to the style and period of the building, shall doors be relocated, enlarged, reduced or 21Pa e 1 introduced. (2). Doors with modern designs, flush or sliding glass doors, or any type of door that is inappropriate to the style or period of the structure are prohibited and unlawful. (c). To the extent that a conclusion of law as set forth herein also constitutes a factual finding, then such shall be taken to be so as part of this Development Order. (d). The proposed Certificate of Appropriateness is hereby found and determined to comply with the aforestated. (e). Additionally, the Certificate of Appropriateness sought is hereby found and determined to be consistent with the City of Sanford Comprehensive Plan and development of the property as proposed would be consistent with and in compliance to applicable land development regulations and all other applicable regulations and ordinances as set forth in the Code of Ordinances of the City of Sanford. NOW, THEREFORE, IT IS ORDERED THAT: (1). The aforementioned application for a Certificate of Appropriateness is APPROVED with the condition that the paneled rear door be replaced with a flat metal door, subject to City staff approval with any dispute between the Property Owners and the City staff being resolved by the HPB at a public hearing and issuance of a development order or denial development order. (2). This Development Order granting approval of a Certificate of Appropriateness touches and concerns the aforedescribed property and is subject to 31Pav,e aggressive code enforcement action in accordance with the controlling provisions of Done and Ordered on the date first written below. As approved and authorized for execution by the Historic Preservation Board of the City of Sanford at its meeting of October 20, 2021.
