3179 ORDINANCE NO. 3179 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CREATING AN EQUITY STUDY COMMITTEE FOR THE PURPOSE OF MAKING RECOMMENDATIONS TO THE CITY COMMISSION CONCERNING AMENDMENTS TO THE CITY CODE RELATING TO OCCUPATIONAL LICENSE TAXCLASSIFICATIONS ANDFEE STRUCTURES; PROVIDING FOR COMPOSITION, ORGANIZATION AND DUTIES OF SAID COMMITTEE; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFOND, FLORIDA: SECTION 1: There is hereby created and constituted an Equity Study committee for the City, which shall consist of not less than 5, nor more than 10 persons to be appointed and confirmed by the City Commission. SECTION 2: The purpose of the Equity Study Committee is to review the City Code relating to occupational licensing and to make recommendations to the City Commission regarding classifications and fee structures. SECTION 3: The City Commission shall select as members of the Equity Study Committee representatives of the business community within the City of Sanford and whenever possible, membership should include representatives of the following: Chamber of Commerce Retail/Wholesale Business Manufacturing Business Repair Business Service Business Professionals (3) Contractor No employee of the City of Sanford shall be eligible for membership on the Equity Study Committee. Members of the Equity Study Committee advisory board may be removed by majority vote of the City Commission for misfeasance, malfeasance and/or dereliction of duty. Failure to attend two (2) consecutive meetings of the Equity Study Committee without prior approval of the chairman shall constitute automatic removal from board membership. In the event of a vacancy on the Equity Study Committee, a successor shall be appointed by the City Commission for the unexpired term of the removed board member. SECTION 4: The members of the Equity Study Committee shall serve from their appointment until September 30, 1994, unless their term of office is otherwise extended by subsequent action of the City Commission. SECTION 5: (A) The Equity Study Committee is empowered to consider and study the City Code and Statutes relating to occupational licensing, to review classifications and fee structures regarding same, and to make recommendations to the City Commission for action. (B) Members of the Equity Study Committee shall receive no compensation and may spend only such sums as may be appropriatedby the City Commission. (C) The Equity Study Committee shall recommend to the City Commission such actions relating to occupational licensing as seem warranted, but shall not concern itself with the day-to-day affairs of normal City functions. SECTION 6: SEVERABILITY. If any section, sentence, phrase, word, or portion of this Ordinance is determined to be invalid, unlawful, or unconstitutional, said determination shall be held to invalidate or impair the validity, force, or effect of any other section, sentence, phrase, word, or portion of this Ordinance not otherwise determined to be invalid, unlawful, or unconstitutional. SECTION 7: CONFLICTS. All ordinances or resolutions or parts of ordinances or resolutions in conflict herewith are hereby repealed to the extent of any conflict. SECTION 8: EFFECTIVE DATE.
