Murdaugh and Sara Murdaugh (03-20-31-5AY-0000-0878) are the owners of the property which is the subject of this Ordinance (Tax Parcel Identification Numbers 03-20-31-5AY-0000-0880, 03-20-31-5AY-0000-087B and 03-20-31-5AY-0000-088A) as assigned by the Seminole County Property Appraiser); and Whereas, the subject real property (a site 11.29 acres in size) is located on the north side of Eaglewoods Trail and west of Skyway Drive and is generally addressed as 3700 Kentucky Street; and Whereas Israel De La Rosa of Appian Engineering LLC is serving as the applicant and representative of the Property Owners; and Whereas, the Property Owners have annexed the 11.29 acres into the City Limits of the City by means of the City Commission enacting Ordinance Number 4623 11 P a g Whereas, the Property Owners have annexed the 11.29 acres into the City Limits of the City by means of the City Commission enacting Ordinance Number 4623 on September 27, 2021 upon petition by the Property Owners and, upon annexation, in accordance with the requirements of controlling Florida law, the City must assign a City land use designation and zoning district/classification to the property; and Whereas, Mr. De La Rosa, was responsible for completing the modified CAPP (Citizens Awareness and Participation Plan) process which was accomplished to the satisfaction of the City; and Whereas, the subject real property is located within Sub Area 4 of 2015 Seminole County/City of Sanford Joint Planning Agreement (JPA); and Whereas, Exhibit "B" of the JPA describes equivalent future land use designations in the City and the County comprehensive plans which land use designations have been deemed equivalent due to their similar intensities and densities of allowable development; and Whereas, the Property Owners have requested, as part of the incorporation into the City's Comprehensive Plan, for the City to modify the land use designation to a land use designation more compatible to those immediately adjacent that will support the proposed future development with a concurrent application requesting the subject property to be incorporated into the Kentucky Square PD; and Whereas, the City's Planning and Development Services Department has conducted a thorough review and analysis of the JPA, the demands upon public facilities and general planning and land development issues should the subject 2 1 P a g e application be approved and has otherwise reviewed and evaluated the application to determine whether it comports with sound and generally accepted land use planning practices and principles as well as whether the application is consistent with the goals, objectives and policies set forth in the City's Comprehensive Plan and determined that the proposed amendment of the City's Comprehensive Plan relative to the subject property as set forth in this Ordinance is internally consistent with the Comprehensive Plan of the City of Sanford and is consistent with the JPA and controlling provisions of State law; and Whereas, the City of Sanford's Planning and Zoning Commission, as the City's local planning agency, held a public hearing on January 6, 2022 to consider amending the Future Land Use Map of the Future Land Use Element of the City of Sanford Comprehensive Plan and recommended approval of the proposed Future Land Use Map amendment to the Comprehensive Plan for the subject property as requested by the Property Owners; and Whereas, Section 163.3187, Florida Statutes, relates to the amendment of adopted local government comprehensive plans and sets forth certain requirements relating to small scale amendments and which are related to proposed small scale development activities and provides, among other things, that such amendments may be approved without regard to statutory limits on the frequency of consideration of amendments to the City of Sanford Comprehensive Plan; and Whereas, the City of Sanford has complied with all requirements and procedures of Florida law in processing this amendment to the City of Sanford Comprehensive Plan including, but not limited to, Section 163.3187, Florida Statutes; M. Whereas, the City of Sanford has complied with Florida's Community Planning Act which was amended during the 2021 Legislative Session by the passage of Committee Substitute for Committee Substitute for Committee Substitute for House Bill Number 59 (initially codified as Chapter Number 2021-195, Laws of Florida) to require every city and county within the State "to include in its comprehensive plan a property rights element" (Section 163.3177(6)(i)1, Florida Statutes). Now, therefore, be in enacted by the People of the City of Sanford, Florida: Section 1. Legislative findings and intent. (a). The City of Sanford has complied with all requirements and procedures of Florida law in processing and advertising this Ordinance. (b). This Ordinance is internally consistent with the goals, objectives and policies of the Comprehensive Plan of the City of Sanford and the proposed Comprehensive Plan amendment does not trigger any urban indicators and adoption of this amendment will discourage the proliferation of urban sprawl within the City of Sanford. Section 2. Amendment to Future Land Use Map. (a). The Future Land Use Plan Element of the Comprehensive Plan of the City of Sanford and the City's Future Land Use Map is hereby amended by changing the land use designation from Seminole County SE, Suburban Estates, to City LDRSF, Low Density Residential — Single Family, with regard to the real property which is the subject 4 1 P a g e of this Ordinance as set forth herein. (b). The property which is the subject of this Comprehensive Plan amendment is assigned Tax Parcel Identification Numbers 03-20-31-5AY-0000-0880, 03-20-31- 5AY-0000-087B and 03-20-31-5AY-0000-088A by the Seminole County Property Appraiser. Section 3. Implementing Administrative Actions. The City Manager, or designee, is hereby authorized to implement the provisions of this Ordinance as deemed appropriate and warranted. Section 4. Ratification Of Prior Actions. The prior actions of the City Commission and its agencies in enacting and causing amendments to the Comprehensive Plan of the City of Sanford, as well as the implementation thereof, are hereby ratified and affirmed. Section 5. Severability. If any section, sentence, phrase, word, or portion of this Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity or effect of any other action or part of this Ordinance. Section 6. Conflicts. All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 7. Codification/instructions to Code Codifier. No additional staffing is anticipated if the land use amendment is approved. BACKGROUND: The 11.29 acre site consists of three parcels, and is located on the north side of Eaglewoods Trail and west of Skyway Drive. The three parcels were annexed on September 27, 2021 through Ordinance No. 4623. Per Exhibit B of the 2015 City of Sanford/Seminole County Joint Planning Agreement (JPA), SE, Suburban Estates, (Seminole County Land Use Designation) is equivalent to SE, Suburban Estates (City of Sanford Land Use Designation). Exhibit B describes equivalent future land use designations in the City and the County comprehensive plan. The designations have been deemed equivalent due to their similar intensities and densities of allowable development. The applicant has requested, as part of the incorporation into the City's Comprehensive Plan, to modify the land use to a land use more compatible to those immediately adjacent that will support the proposed future development. In addition, a concurrent application requesting the three parcels be incorporated into the Kentucky Square PD to the north has been submitted. The subject parcels fall within sub -area 4 of the JPA Exhibit C identifies the following excerpts apply to this land use conversion: An east -west alignment established by Eaglewoods Trail shall serve as a dividing line for residential density within Planning Area 4. Properties to the north of this line shall develop at a maximum of 3.5 units per net buildable acre. Properties lying south of this line and north of Pineway shall develop at a maximum of 2.5 units per net buildable acre. These densities shall not apply to properties currently assigned the County HIP AP Future Land Use designation. Future expansion of the Orlando -Sanford International Airport (OSIA) property and runways shall be focused to the east and south to minimize airport noise and development impacts to urban residential areas to the north and west. Lands annexed near or adjacent to the airport shall be assigned land use designations compatible with the Airport Master Plan and in a manner consistent with the joint planning agreement established with Seminole County. Residential land uses and residential zonings shall be discouraged if within three hundred (300) feet of the centerline of the OSIA's new runway system east to the conservation area adjacent to Lake Jesup. The areas delineated for LDR-SF development shall include existing stable single family areas, as well as those areas identified for future low density residential single family development in order to provide sufficient land area to meet projected single family housing needs. Areas delineated as LDRSF shall allow residential development with a maximum density of up to six dwelling units -per acre comprised of single family detached homes on individual lots. Supportive community facilities and accessory land uses as defined in the LDRs may be located within areas designated LDR-SF. As part of the review, the proposed modification has been found to meet the above criteria. The City will also coordinate with the School Board regarding residential development within this district as required in the Public School Facilities Element to ensure the availability of adequate school facilities. LEGAL REVIEW: This matter is not a quasi-judicial matter as amendments to local government comprehensive plans are legislative in nature. That being said, if a proposal to amend the City's Comprehensive Plan is to be recommended for denial, it would be appropriate to state the particular reason for such a recommendation to be considered by the City Commission - such as the proposal is internally inconsistent with a goal, objective or policy of the Comprehensive Plan or inconsistent with controlling State law or the like. When lands are subject to the provisions of the City/County JPA; the City is bound to adhere to the provisions of the JPA. Also, Section 171.062, Florida Statutes, pertaining to the effects of annexations or contractions, anticipates that cities will expeditiously incorporate annexed properties into their comprehensive plans and land development regulations upon being located within the city limits of the annexing municipality. The City Commission approved the first reading of Ordinance No. 4666 on January 24, 2022. The City Clerk published notice of the 2nd Public Hearing in the Sanford Herald on February 2, 2022. RECOMMENDATION: Staff finds that the small scale land use amendment is appropriate and suitable for the subject site and is compatible with the surrounding land uses and is consistent with the City of Sanford Comprehensive Plan, Joint Planning Agreement and Chapter 163 of Florida Statutes. The first concern being the additional traffic and if there are any improvements planned for Kentucky St. The second concern is the drainage in the area, if fill is required, he is asking where the excess water would go. The third concern is the wildlife in the area. The traffic is mainly caused by the school and drainage will be accommodated per code. Vivian and Neil Enfinger main concern is privacy, they would like some of the existing greenery in front of their home to not be removed so they can keep the rural feel. They ask to consider not building two story homes facing their property for privacy reasons, which the builder explained is up to the purchasing homeowner, not developer. They also state that it would nice if modem day intemet were hooked into the subdivision that way, they could be included in that. Another big concern of Vivian is the possibility of onsite burning during demolition, she states that she has a serious respiratory disease and smoke triggers it and if burning is required to do it as far from her property or not to bum at all if possible. We will work with the owners to accommodate burning. The owner stated that they would reach out to the property owners if they have future concerns. I have 3 concerns with new development: traffic, drainage and wildlife. With the addition of the Galileo School there has been a significant increase of traffic traveling on Kentucky St to Sipes Ave from the school. During times that school is starting (about 8:30) or ending (about 3:30) for the day there is a constant stream of cars coming from either Lake Mary Blvd or Sipes Ave and going down Kentucky St. Also Skyway Dr during these times has backed tip traffic from the school to Lake Mary Blvd. The tiny bridge across Kentucky St is in need of repair. There is a sink hole developing on the south side of the bridge that appears to be marked by the highway department. Repair on the bridge will essentially shut down the access to Sipes Ave on Kentucky St. Now with the proposed Kentucky Square development there will be more traffic on Kentucky St and Skyway Dr from the 149 new homes. One access to Kentucky Square looks like it will come out directly in front of the Galileo School entrance. There is also another proposed development of 94 townhomes on 3100 Kentucky St that will contribute to congestion in this area. My concern about this additional traffic leads me to ask if there are any improvements (widening, traffic lights, etc) planned for Kentucky St? In reference to drainage; I know that this area is not designated as a wetland but at 3739 Sipes there is always standing water when there is a lot of rain. All of these developments will bring in much fill dirt to elevate their area and thus leading to the water flowing to lower areas. I am unsure where the excess water will go. In reference to wildlife; There are numerous gopher turtles on the 3739 Sipes Ave property and on the 3100 Kentucky St property. I would be very surprised if there are not turtles on the Kentucky Square property. I hope that the site preparation team takes this into consideration. At 3739 Sipes we occasionally see wild pigs. They come up to higher ground from the prairie around Lake Jessup when there has been a lot of rain. The folks at the Kentucky Square property are going to be really surprised when the pigs destroy their new lawns in the rainy season.
