PROCEEDING BEFORE THE ASSISTANT CITY ATTORNEY APPOINTED AS
HEARING OFFICER FOR THE CITY OF SANFORD, FLORIDA
IN RE: THE MATTER OF CONTENTS
OF SAFE RESULTING FROM EVENTS
OF NOVEMBER 13, 2021.
THIS CAUSE came before the undersigned Hearing Officer on Wednesday,
February 16, 2022, at approximately 1:00 P.M. at the offices of Stenstrom, McIntosh,
Colbert & Whigham, P.A., 300 International Parkway, Suite 100, Lake Mary, Florida
32746, in accordance with his assignment as the appointed Hearing Officer of the City of
Sanford implemented by Norton N. Bonaparte, Jr., ICMA-CM, City Manager of the City of
Sanford, under the provisions of Section 26-103 (c) of the Sanford City Code.
The Hearing Officer, having held a hearing, heard the evidence presented by
Investigator Jenna Smith, Melanie Marie Smoker and Jazmine Alexis Smoker, reviewed
the police reports submitted in this case, and being otherwise fully advised in the
premises, FINDS and ADJUDICATES as follows: The claim of Melanie Marie Smoker is
well founded as to the contents of the safe that is the subject of this proceeding. The
contents thereof held by the City of Sanford Police Department shall be released to
Melanie Marie Smoker upon the appeal period (10 working days from the date of this
decision) expiring without appeal subject to the prior actions of the Police Department
which occurred in accordance with the controlling provisions of law. If this matter is
appealed to the City Commission, the jurisdiction of the Hearing Officer as to this matter
shall be divested. It was agreed, found and determined that the cash as enumerated in
the police reports and the other contents outlined in the police reports was and is the total

amount of cash and other contents ever in the possession of the City of Sanford and that
the destruction of the marijuana that was located in the safe was in accordance with the
controlling provisions of law.
