3141 ORDINANCE NO. 3141
AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING
SECTION 5(C) OF ORDINANCE NO. 2030; SAID ORDINANCE BEING A
FIRE IMPACT FEE ORDINANCE; TO AMEND SECTION 5(C) TO
INCREASE IMPACT FEES; PROVIDING FOR SEVERABILITY,
CONFLICTS AND EFFECTIVE DATE.
WHEREAS, the City of Sanford, Florida desires to amend the Fire Public Safety
Facilities Impact Fee.
WHEREAS, under Section 4 of Ordinance No. 2030, the City Commission of the
City of Sanford is required to determine and review Impact Fees at least every other
year; and
WHEREAS, a Fire Protection Impact Fee Background Report was prepared by
Solin and Associates and reviewed by the City's System Development Fee Advisory
Committee; and
WHEREAS, the City Commission determines that it is necessary to increase
impact fees to assess against new construction its fair share of the cost to finance
new improvements.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That Section 5(C) of Ordinance 2024 shall be amended to read as
follows:
C. AMOUNT OF FEE. The fire public safety facilities fee to be paid prior to
or in conjunction with the issuance of a building permit shall be levied based upon
the following formula and in the following amounts:
1. Residential: (CAI x RC)/RDU = Cost Per Dwelling Unit:
$59.27 per residential dwelling unit
2. Commercial
and other: Cost Per Square Foot:
$. 0345 per square foot of commercial development
3. Industrial: Cost Per Square Foot:
$. 0025 per square foot of industrial development
SECTION 2: If any section or portion of a section of this ordinance proves to
be invalid, unlawful or unconstitutional, it shall not be held to impair the validity,
force or effect of any other section or part of this ordinance.
SECTION 3: That all ordinances or parts of ordinances in conflict herewith
be and the same are hereby revoked.
SECTION 4: That this ordinance shall become effective immediately upon its
passage and adoption.
