3105 ORDINANCE NO. 3105 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, TO ADOPT THE 1991 EDITION OF THE BUILDING CODE, GAS CODE, STANDARD MECHANICAL CODE, PLUMBING CODE, AND STANDARD HOUSING CODE; PROVIDING FOR SEVERABILITy, CONFLICTS AND EFFECTIVE DATE. WHEREAS, it is the desire of the City commission of the City of Sanford to adopt the 1991 Edition of the various codes relating to building, gas, mechanical, plumbing, and housing codes; and WHEREAS, the adoption of the revisions of these Codes is done to facilitate proper inspection activities by the City of Sanford, Florida, relating to construction and to maintenance of buildings within the corporate limits of said city and relating to the prevention of hazards such as fire; and WHEREAS, the adoption of the revisions to the codes is done to facilitate proper inspection activities by the City of Sanford, Florida, relating to construction and to maintenance of buildings within the corporate limits of said City. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA, that the following revisions to the Codes are hereby adopted as follows: SECTION 1: Chapter 6, Buildings, Section 6.1 of the standard Building Code, entitled "Adoption of Standard Building Code", is hereby deleted in its entirety and the new Section 6.1 is adopted as follows: Adoption of 1991 edition. The Standard Building Code, 1991 edition prepared by the southern Building Code congress, is hereby adopted by the city, and a copy of same is filed in the office of the city Clerk as a matter of permanent record of the City, and the matters and contents therein are made a part of this section by reference as fully and completely as if set forth herein, and such copy shall remain on file in said office available for public inspection. SECTION 2: Chapter 6-1.1, Buildings, Section 403.2 of the standard Building Code entitled "Tenant Separation", is hereby deleted in its entirety and Sections 403.4 and 702.1.3 are adopted as follows: section 403.4 of the standard Building Code, entitled "Tenant Separation," is hereby amended to read as follows: In a building, or portion of a single occupancy classification, when enclosed spaces are provided for separate tenants, such spaces shall be separated by not less than one hour fire resistance. EXEMPTION: Regardless to type of construction, nonrated partitions may be constructed within rooms or spaces in buildings not exceeding three thousand (3,000) total square feet in area of group B-Business and S-Storage occupancies. Section 702.1.3 of the Standard Building Code is amended to read as follows: All other partitions required to have fire resistance rating shall extend from the top of the floor below to the ceiling above and shall be securely attached thereto. In all multi-family units with attic above, firewall between units will extend from floor to under side of roof sheathing. Where said ceiling is not a part of an assembly having a fire resistance rating at least equal to that required for the partition, the partition shall be constructed tight against the floor or roof deck above. The design of the partitions or ceilings and any openings shall be such as to prevent spread of smoke to the corridor. SECTION 3: Chapter 6, Buildings, Appendix A, Subsection A101.4.1 and A101.4.2 of the Code, entitled "Building official Qualifications" and "Inspection Qualifications" are hereby deleted in their entirety. Sections 101.4.1, 101.4.2, 101.4.3 and 101.4.4 of the 1991 Standard Building code, entitled "Building Official Qualifications", "Inspector Qualifications", and "Deputy Building Official" are hereby deleted in their entirety. Appendix B of the 1991 Standard Building Code, entitled "Recommended Schedule of Permit Fees" is hereby deleted in its entirety. Appendix E of the 1991 Standard Building Code, entitled "Energy Conservation" is hereby deleted in its entirety. SECTION 4: chapter 12, Section 12-1, Adoption of Gas Code, subsections (a) and (c) are hereby deleted in their entirety and are amended as follows: Subsection (a) Adoption of 1991 edition. The 1991 edition of the Standard Gas code as prepared by the Southern Building code congress, is hereby adopted by the city, one copy Of which is filed in the office of the city clerk as a matter of permanent record of the city, and the matters and contents therein are made a part of this chapter by references as fully and completely as of set forth herein, and such copy shall remain on file in said office available for public inspection. SECTION 5: Section 12-1.1, Gas code Amended, is adopted as follows: (a) Sections 101.4.1, 101.4.2, 101.4.3 and 101.4.4 of the 1991 Gas Code, entitled" Building official Qualifications", "Chief Inspector Qualifications", "Inspector Qualifications", and "Deputy Building Official" are hereby deleted in their entirety. (b) Section 105 of the Standard Gas Code, entitled, "Board Of Adjustment and Appeals" is hereby deleted in its entirety. SECTION 6: Existing adoption of the 1988 edition of the Standard Mechanical code is hereby deleted in its entirety and amended to read as follows: Page -2- Ordinance No. 3105 Adoption of the 1991 edition. The 1991 edition of the Standard Mechanical Code as prepared by the Southern Building Code Congress International, Inc., as amended, is hereby adopted by the City, and a copy of same, as amended, is filed in the City, and the matters and contents therein are made a part of this chapter by reference as fully and completely as if set forth herein, and such copy shall remain on file in said office available for public inspection. SECTION 7: Chapter 16 1/2, Mechanical Code, Section 16t-1.1, Subsections (c), (d) and (h) of the Standard Mechanical Code, entitled "Amendments" is hereby deleted in their entirety and new Subsections (c), (d) and (h) are adopted as follows: (c) Sections 101.4.1, 101.4.2, 101.4.3 and 101.4.4 of the 1991 Standard Mechanical Code, entitled "Building Official Qualifications", "Inspector Qualification", and "Deputy Building Official" are hereby deleted in their entirety. (d) Section 509.2.1 of the Standard Mechanical code entitled "General" is hereby amended to read as follows: Abide by the Standard Mechanical Code as written for Section 509.2.1, "General" as it pertains to "Plenum Chambers." (h) Appendix B of the Standard Mechanical Code, entitled, "Permit Fees" is hereby deleted in its entirety. SECTION 8: chapter 19, Plumbing, Section 19-1 entitled "Adoption of Standard Plumbing code" is hereby deleted in its entirety and new Section 19-1 is adopted as follows: Adoption of 1991 edition. The 1991 edition of the standard Plumbing code as prepared by the southern Building code Congress International, Inc., is hereby adopted by the City clerk as a matter of permanent record of the city, and the matters and contents therein are made a part of this chapter by reference as fully and completely as if set forth herein, and such copy shall remain on file in said office available for public inspection. SECTION 9: Chapter 19, Plumbing, Section 19-3, entitled "Amendments to Code" is hereby deleted in its entirety and new section 19-3 is adopted as follows: Section 1213.7 of the Standard Plumbing Code, entitled "Safety Pans and Relief Valve Waste" is amended to read as follows: When water heaters or hot water storage ranks are installed in such areas that leakage could cause water damage to the building or injury to the building occupants, the tank or heater shall rest in a high impact plastic pan of at least 1/16 inch thickness or a galvanized steel or other metal pan of equal to 0.0276 inch (24 gauge) galvanized sheet steel. Except in garages whether or not on the same floor level as residence. When there is a partition separating hot water heater or storage tank a pan shall be required. Page '3- Ordinance No. 3105 SECTION 10: Chapter 19, Plumbing, Appendix A, Subsection A101.4.2 of the Standard Plumbing code, entitled "Inspector Qualifications" is hereby deleted in its entirety and is amended as follows: Sections 101.4.1, 101.4.2, 101.4.3, and 101.4.4 of the Standard Plumbing Code, entitled "Building Qualifications", "Chief Inspector Qualifications", "Inspector Qualifications", and "Deputy Building Official" are hereby deleted in their entirety. SECTION 11: Chapter 14, Housing, Existing Adoption of 1988 edition is hereby deleted in its entirety and Section 14-1, entitled "Adoption of Standard Housing code" is Adoption of 1991 edition. The 1991 edition of the standard Housing Code, prepared by the Southern Building code Congress, is hereby adopted by the city, and a copy of same is filed in the office of the city Clerk as a matter of permanent record of the City, and the matters and contents therein are made a part of this chapter by reference as fully and completely as if set forth herein, and such copy shall remain On file in said office available for public inspections. SECTION 12: If any section or portion of a section of this ordinance provides to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section Or part of this ordinance. SECTION 13: That all ordinances or parts of ordinances in conflict hereby be and the same are hereby revoked.
