VACATING, E AB~DONING A PORTION OF JESS~I~ A~NUE
LYING BET~EN ~ST SE~ND STMET ~D ~ST THI~ STMET,
PROVIDING FOR SE~BILITY, CONFLICTS ~D EFFECTI~ DATE.
WHEREAS, the owners of that certain real property abutting
JessMine Avenue lying between West Second Street and West Third Street;
applied to the city of Sanford, Florida, their application to have said
property closed, vacated and abandoned; and
WHEMAS, a public hearing was held on April 13, 1992, for
consideration and determination as to whether or not the closing, vacating
and abandoning of that easement should be allowed; and
WHE~AS, the City commission has determined that the closing,
vacating and ~andoning of that certain property does not conflict with the
Comprehensive Plan of the City of Sanford, Florida, and that the public
health, economy, comfort, order, convenience, and welfare will be promoted by
such closing, vacating an abandoning.
NOW, T~FO~, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFO~,
FLORIDA:
SECTION 1: That Jessmine Avenue lying between West Second Street
and West Third Street, more particularly described as follows:
The Easterly 7.28 feet of the 82 foot right-of-way of
Jessmine Avenue lying adjacent to Block 4, Tier 18 of
E.R. Trafford's Map of the Town of Sanford, according to
the plat thereof as recorded in Plat Book 1, pages 56 to
64 of the Public Records of Seminole County, Florida.
be and the see is hereby closed, vacated and abandoned.
SECTION 2: If any section or portion of a section of this
ordinance proves to be invalid, unlawful or unconstitutional, it shall not be
held to impair the validity, force or effect of any other section or part of
this ordinance.
SECTION 3: That all ordinances or parts of ordinances in conflict
herewith be and the s~e are hereby revoked.
SECTION 4: That this ordinance shall become effective immediately
upon its passage and adoption.
