~ O~IN~CE OF THE CITY OF S~FO~, FLORIDA, CLOSING,
VACATING, ~D AB~DONING A UTILITY EASE~NT LYING ON
THE ~STE~Y SIDE OF THE PROPERTY AT 160 WILDWOOD DRIP,
~BLEW~D SUBDIVISION, S~FO~, FLORIDA; PROVIDING FOR
SE~BILITY, CONFLICTS ~D EFFECTI~ DATE.
WHEREAS, the owners of that certain utility easement lying on the
westerly side of the property at 160 Wildwood Drive; applied to the City of
Sanford, Florida, their application to have said property closed, vacated
and abandoned; and
WHEREAS, a public hearing was held on October 14, 1991, for
consideration and determination as to whether or not the closing, vacating
and abandoning of that easement should be allowed; and
WHEREAS, the City Commission has determined that the closing,
vacating and abandoning of that certain property does not conflict with the
Comprehensive Plan of the City of Sanford, Florida, and that the public
health, economy, comfort, order, convenience, and welfare will be promoted
by such closing, vacating an abandoning.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That a utility eas~ent lying on the westerly side of
the property at 160 Wildwood Drive, more particularly described as follows:
The southerly 10 feet of the northerly 35 feet of the 5
foot utility easement along the westerly lot line of Lot
71, R~lewood, Plat Book 23, Pages 7 and 8, as recorded
in the Public Records of seminole County, Florida.
be and the s~e is hereby closed, vacated and abandoned.
SECTION 2: If any section or portion of a section of this
ordinance proves to be invalid, unlawful or unconstitutional, it shall not
be held to impair the validity, force or effect of any other section or part
of this ordinance.
SECTION 3: That all ordinances or parts of ordinances in conflict
herewith be and the see are hereby revoked.
SECTION 4: That this ordinance shall become effective inmaediately
upon its passage and adoption.
