IN THE PUBLIC ~CO~S OF SEMINOLE COUNTY, FLORIDA
PROVIDING FOR SE~BILITY, CONFLICTS ~D EFFECTI~
DATE.
WHEREAS, the owners of that certain real property that certain
portion of Park Avenue lying between West 25th Street (Geneva Avenue) and
West 25th Place extended easterly and between Park Drive and Palmetto
Avenue, as recorded in the Public Records of Seminole county, Florida,
applied to the city Of Sanford, Florida, their application to have said
property closed, vacated and abandoned; and
WHEREAS, a public hearing was held on October 14, 1991, for
consideration and determination as to whether or not the closing, vacating
and abandoning of that easement should be allowed; and
WHEREAS, the City Commission has determined that the
closing, vacating and abandoning of that certain property does not
conflict with the Comprehensive Plan of the city of Sanford, Florida,
and that the public health, economy, comfort, order, convenience, and
welfare will be promoted by such closing, vacating and abandoning.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: That a certain Utility Easement lying in Sanora, more
particularly described as follows:
The Right-of Way known as Park Avenue between 25th
Street (SR #46) and 25th Place, South-East of Park Drive
(Orlando Drive) and between blocks 2 and 3, Spurling
Heights, as recorded in Plat Book 6, Page 17, Of the
Public Records of Seminole County, Florida.
be and the same is hereby closed, vacated and abandoned, but a utility
easement is retained over same.
SECTION 2: If any section or portion of a section of this
ordinance proves to be invalid, unlawful or unconstitutional, it shall not
be held to impair the validity, force or effect of any other section or part
of this ordinance.
