3089 ORDINANCE NO. 3089 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING CHAPTER 6, "BUILDINGS", OF THE CODE OF ORDINANCES OF THE CITY OF SANFORD, PROVIDING EXEMPTIONS TO PERMIT REQUIREMENTS FOR CERTAIN TENTS AND CANOPIES; pROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY AND EFFECTIVE DATE. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: Section 1: That Chapter 6, Article I~ Section 6-12 of the Code of Ordinances of the City of Sanford is hereby amended to read as follows: Section 6-12. Tent Permits. (a) Permit Required. No tent shall be erected within the City until a permit has been obtained from the Building Division and the Fire Department. (1) Tents/canopies meeting all of the following requirements will be exempt from permitting through the Building Division: (a) Is 400 square feet or less; and (b) Does not have attachable sides; and (c) Does not have provisions for electricity; and (d) Is not utilized for a place of assembly for more than 50 people; and (e) Does not provide for the sale of hazardous materials. (2) All tents/canopies require a permit from the fire department. (b) Application Procedure. (1) Letter from property owner, authorizing use of property. (2) Certification of tent fire resistance, effective for the period specified by the permit. (3) Tent permit application form. (c) Conditions. Permit will be issued upon submittal of above documents, applicable fee paid and contingent upon the below conditions: (1) Inspection requested when grounds are prepared, by cutting grass, removing debris, or any other potential fire hazards, and electric service is read for connection. Inspection approval will authorize erection of tent. 2) Request final inspection by the Building Division and fire prevention inspector when tent is erected, sanitary facilities are provided, and seats and fire extinguishers are installed. 3) Tent shall not be occupied or electrical service connected until satisfactory final inspections have been performed. 4) Permits are limited to two (2) weeks, with provisions for one (1) extension of two (2) weeks after satisfactory reinspection to ensure safety to life conditions have not deteriorated. (5) No tent shall be permitted on a site for a period longer than twenty-eight (28) days. No permit shall be obtained for the same site within a period of one hundred eighty (180) days following expiration of a tent permit. (6) Adequate parking shall be provided as a condition precedent to the issuance of a tent permit. (Ord. No. 1976, 1, 10-10-88) Section 2: Specific authority is hereby granted to codify and incorporate this Ordinance in the existing code of Ordinances of the City of Sanford. Section 3: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. Section 4: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked.
