3057 I 3 8 I 2 G t R: 2s PM I: OEDINANCE ~O. 3057 CLOSZ~G, V~CATZ~G, ~D ~DO~Z~G ~O~OHS O~ ~ FULTON STREET LYING BETWEEN PEC~ AVENUE EXTENDED NOR~ERLY AND CED~ AVENUE EXTENDED NORTHERLY ~D BETWEEN WEST FIRST ST~ET (SR 46) ~D US 17 & 92 (SEMINOLE BOULEVA~) BUT RESERVING UTILITY EASEMENTS OVER S~E; PROVIDING FOR SEVE~ILI~, CONFLICTS ~D EFFECTIVE DATE. ~ER~S, the o~ers of portions of Fulton Street lying between Pecan Avenue extended northerly and Cedar Avenue extended northerly and between West First Street (SR 46) and US 17 & 92 (Seminole Boulevard), applied to the City of Sanford, Florida, their application to have said property closed, vacated and abandoned; and ~EREAS, a public hearing was held on~rch 11, 1991, for consideration and determination as to whether or not the closing, vacating and abandoning of that property should be allowed; and ~EREAS, the City Co~ission has dete~ined that the closing, vacating and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, and welfare will be promoted by such closing, vacating an abandoning. NOW, THEREFORE, BE IT ENACT~ BY THE PEOPLE OF THE CITY OF S~FO~, FLORIDA: SECTION 1: That portions of Fulton Street lying between Pecan Avenue extended northerly and Cedar Avenue extended northerly and between West First Street (SR 46) and US 17 & 92 (Seminole Boulevard), more particularly described as follows: That portion of right-of-way for Fulton Street adjacent to Lots 1, 2, and 3 of St. Gertrude's addition to the To~ of Sanford, Block 1, page 113 of the Public Records of Seminole County, Florida; ~D ~SO that portion of said Fulton Street lying 150 feet East of the Easterly right-of-way of Poplar Avenue. be and the same is hereby closed, vacated and abandoned but utility SECTION 2: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 4: That this ordinance shall become effective immediately upon its passage and adoption.
