(Waste Pro). FISCAL/STAFFING STATEMENT: Based on the current Solid Waste Franchise Agreement, a rate adjustment is allowed to reflect any unusual or extraordinary changes in cost. The potential estimated pass through increase to commercial and residential customers could result as follows: Current Residential Monthly Rate: $16.72 $0.19 increase: $16.91 Current Commercial Dumpster Cubic Yard Rate: $5.19 $0.28 increase: $5.47 On June 1, 2007 the City and Waste Pro entered into a Residential and Commercial Solid Waste and Recyclable Materials and Related Materials Collection, Transport and Disposal Services Franchise Agreement. In Section 13: Rate Increases of the Franchise Agreement, it states "Beginning July 1, 2009, and annually thereafter, Contractor, upon 90 days written notice, may receive an adjustment to service charges to reflect changes in the Consumer Price Index. The C.P.I. adjustment shall not exceed three percent per year. The contractor may also petition the City Commission for rate adjustments to reflect any unusual or extraordinary changes in cost. The City Commission has the final authority to approve, disapprove, or modify such requests." The City received a letter from Waste Pro dated January 28, 2022 (attached), requesting a rate increase, subsequent to the Seminole County Landfill increase (attached) and staff agreed to request the City Commission grant a price adjustment increase based on "unusual and extraordinary changes in cost." If approved, the increased rates would become effective, nunc pr•o lunc to March 1, 2022. LEGAL REVIEW: The City Attorney has reviewed the proposed rate adjustment increase and has no legal objection. RECOMMENDATION: City staff recommends that the City Commission approve the landfill rate adjustment increase for Waste Pro.
