FISCAL/STAFFING STATEMENT: This matter relates to the City's involvement in opioid litigation seeking appropriate legal remedies against manufacturers and others involved in the National crisis involving opioid pain medications. BACKGROUND: In connection with the ongoing opioid crisis, the State of Florida Office of the Attorney General filed an amended complaint asserting various claims against CVS for public nuisance, negligence, conspiracy, fraud and violations of the Florida Deceptive and Unfair Trade Practices Act and Racketeer Influenced and Corrupt Organization Act, all based on allegations that CVS historically, among other acts, distributed and dispensed prescription opioid pain medication improperly in a fashion that caused harm to the health of Florida residents and to the State. The action sought damages, equitable abatement, civil penalties, attorneys' fees and litigation costs, and other relief. Additionally, the State of Florida Office of the Attorney General filed complaints against Allergan plc and Teva Pharmaceuticals alleging that, among other things, both Allergan and Teva (i) violated Florida law by deceptively marketing opioid pain medications so as to overstate their efficacy and downplay the associated risk of addiction, which resulted in a public nuisance in Florida; (ii) violated the law by failing to monitor, report and not ship allegedly suspicious orders of opioid pain medications; and (iii) violated Fla. Stat. §895.03(3),(4). The actions asserted claims for damages, equitable abatement, civil penalties, attorneys' fees and litigation costs, and other relief. The City is represented, based upon past City Commission actions, by a legal team that is spearheaded by the Romano Law Group, of West Palm Beach, FL. The City has been advised by the Romano Law Group that the State of Florida has now reached settlements with CVS, Allergan and Teva in the opioid litigation filed. The proposed settlements are comprised of cash and product to combat the opioid crisis in Florida. With respect to the cash portion, the total is approximately $813,026,499 ($484 million from CVS to be paid over 18 years and $329,026,499 from Teva/Allergan to be paid over l I years). The proposed settlements also include approximately $84 million worth of product to combat the opioid crisis (Narcan). These settlement funds will be allocated between the State and local subdivisions pursuant to the existing statewide allocation agreement (aka the MQU), using the same allocation model applied to prior settlements. Estimated allocations to each city and county can be found on the attached spreadsheet (these estimates assume 100% statewide participation by litigating entities). The Romano Law Group recommends the City participate in all three proposed settlements, which are very similar to the Subdivision Settlement Participation Forms the City has previously executed for prior settlements. LEGAL REVIEW: The City Attorney's office recommends the City Commission follow the recommendation of the Romano Law Group and authorize direct that the City Manager execute the Subdivision Settlement Participation Form for each settlement on behalf of the City. RECOMMENDATION: City staff recommends that the City Commission follow the recommendation of the Romano Law Group and authorize direct that the City Manager execute the Subdivision Settlement Participation Form for each settlement on behalf of the City. SUGGESTED MOTION: "I move to follow the recommendation of the Romano Law Group with regard to Participation Agreements in proposed settlements between the State of Florida and CVS, Allergan and Teva and authorize and direct the City Manager to execute the Subdivision Settlement Participation Form on behalf of the City for each settlement." The Governmental Entity is aware of and has reviewed the Allergan Settlement, understands that all terms in this Subdivision Settlement Participation Form have the meanings defined therein, and agrees that by signing this Subdivision Settlement Participation Form, the Governmental Entity elects to participate in the Allergan Settlement and become a Participating Subdivision as provided therein. 2. The Governmental Entity shall immediately cease any and all litigation activities as to the Releasees and Released Claims and, within the later of 7 days following the entry of the Consent Judgment or 7 days of the Execution Date of this Subdivision Settlement Participation Form voluntarily dismiss with prejudice any Released Claims that it has filed.
