AN O~INANCE OF THE CITY OF SANFO~, FLORIDA,
CLOSING, VACATING, AND ~ANDONING A PORTION OF AN ¢~.
ALLEY LYING BETWEEN ELM AVENUE AND MYRTLE AVENUE
AND BE~EEN PARK AVENUE AND (SR 46) WEST 25TH
STREET, AND RETAINING A UTILI~ EASE~NT THEREIN;
PROVIDING FOR SEVERABILI~, CONFLICTS AND
WHEREAS, the owners of that certain real property of anC~
alley lying between Elm Avenue and Myrtle Avenue and between Park
Avenue and (SR 46) West 25th Street, applied to the City of Sanford,
Florida, their application to have said property closed, vacated and
abandoned; and
WHEREAS, a public hearing was held on September 10, 1990,
for consideration and determination as to whether or not the closing,
vacating and abandoning of that easement should be allowed; and
WHEREAS, the City Commission has dete~ined that the
closing, vacating and abandoning of that certain property does not
conflict with the Comprehensive Plan of the City of Sanford, Florida,
and that the public health, economy, comfort, order, convenience, and
welfare will be promoted by such closing, vacating an abandoning.
NOW, THEREFORE, BE IT ENACTED BY ~E PEOPLE OF THE CITY OF
SANFO~, FLORIDA:
SECTION i: That lying between Elm Avenue and Myrtle Avenue
and between Park Avenue and (SR 46) West 26th Street particularly
described as follows:
That certain 14 foot wide alley lying between and
abutting Lots 13 & 14 and between and abutting
Lots 28 & 29, Block 3, Dreamwold 2nd Section, Plat
Book 4, Page 30, Public records of Seminole
County, Florida.
be and the same is hereby closed, vacated and abandoned, but a utility
easement is retained over same..
SECTION 2: If any section or portion of a section of this
ordinance proves to be invalid, unlawful or unconstitutional, it shall
not be held to impair the validity, force or effect of any other
section or part of this ordinance.
SECTION 3: That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby revoked.
SECTION 4: That this ordinance shall become effective
immediately upon its passage and adoption.
