I ~EREAS, the o~er of that certain real property abutting ~ an east-west alley between East Second Street and East Third Street ~ and between Sanford Avenue and Cypress Avenue applied to the City of ~ Sanford, Florida, her application to have said property closed, ~ vacated and abandoned; and ~ ~ ~EREAS, a public hearing was held on September 24, 1990, · ' ~ for consideration and determination as to whether or not the closing, ~ ~ vacating and abandoning of that easement should be allowed; and OO m ~ ~EREAS, the City Co~ission has determined that the · ~ closing, vacating and abandoning of that certain property does not ~ ~ conflict with the Comprehensive Plan of the City of Sanford, Florida, ~ and that the public health, economy, comfort, order, convenience, and · ~ welfare will be promoted by such closing, vacating an abandoning. So ~ m NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF '~ S~FO~, FLORIDA: e" SECTION 1: That an east-west alley between East Second OO ~ ~ Street and East Third Street and between Sanford Avenue and Cypress Avenue, more particularly described as follows: That certain alley lying east and west in Block 9, ~'~ Chapman & Tucker's Addition, according to the Plat n ..~ thereof as recorded in Plat Book 1, page 24, ~ Public Records of Seminole County, Florida. ~ ~ be and the same is hereby closed, vacated and abandoned. · o SECTION 2: If any section or portion of a section of this ~ o ordinance proves to be invalid, unlawful or unconstitutional, it shall ~ not be held to impair the validity, for~e or effect of any other ~ ~ section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked.
