3049 ORDINANCE NO. 3049 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, READOPTING AND AFFIRMING THE PROVISIONS OF ORDINANCE NO. 3033, WHICH PURPORTED TO CHANGE THE ZONING OF A PORTION OF THAT CERTAIN PROPERTY LYING BETWEEN SILVER LAKE ROAD EXTENDED WESTERLY AND NORTH WAY EXTENDED WESTERLY AND BETWEEN S.C.L. RAILROAD RIGHT-OF-WAY AND SIPES AVENUE FROM AG, AGRICULTURAL, TO MI-2, MEDIUM INDUSTRIAL; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, on October 8, 1990, the City adopted Ordinance No. 3033, which purported to change the zoning~of a portion of that certain property lying between Silver Lake Road extended Westerly and North Way extended Westerly and between S.C.L. RAilroad right-of-way and Sipes Avenue from AG, Agricultural, to MI-2, Medium Industrial; and WHEREAS, the change of zoning should have been preceeded by an amendment to the City's Comprehensive Land Use Plan; and WHEREAS, the City's Comprehensive Land Use Plan was amended by Ordinance No. 3043, which was adopted and effective on December 17, 1990; and WHEREAS, the City desires to readopt and affirm the provisions of Ordinance No. 3033. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That the provisions of Ordinance No. 3033 adopted on October 8, 1990, which purported to amend Ordinance No. 1990 of the City of Sanford, Florida, passed and adopted December 28, 1988, said Ordinance being the Comprehensive Zoning Ordinance of the City of Sanford, Florida, regulating and restricting the location and use of buildings, structures, land, and water from trade, industry, residence or other purposes, be and the same is hereby amended as follows: The South 1/2 of the Southwest 1/4 of Sec 8, Twn 20 S, Range 31 E; as recorded in the Public Records of Seminole County, Florida; be and the same is hereby rezoned from AG, AGricultural, to MI-2, Medium Industrial, is hereby readopted and affirmed. SECTION 2: If any section or portion of a section of this 0rdinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this Ordinance. SECTION 3: That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby revoked. SECTION 4: That this Ordinance shall become effective immediately upon its passage and adoption. PASSED AND ADOPTED this/~day of January, A.D. 1991.
