~ O~IN~CE OF THE CITY OF S~FO~, FLORIDA,
CLOSING, VACATING, ~D ~DONING A PORTION OF A
10 FOOT EAST-~ST D~INAGE ~D UTILITY EASE~NT IN
BRISTOL CIRCLE, PROVIDING FOR SEVERABILITY,
CONFLICTS ~D EFFECTIVE DATE.
~EREAS, the o~er of that certain real property lying in a
10 foot wide portion of an east-west drainage and utility easment in
Bristol Circle, applied to the City of Sanford, Florida, their
application to have said property closed, vacated and abandoned; and
~EREAS, a public hearing was held on June 25, 1990, for
consideration and determination as to whether or not the closing,
vacating and abandoning of that easement should be allowed; and
~EREAS, the City Co~ission has dete~ined that the
closing, vacating and abandoning of that certain property does not
conflict with the Comprehensive Plan of the City of Sanford, Florida,
and that the public health, economy, comfort, order, convenience, and
welfare will be promoted by such closing, vacating and abandoning.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CI~ OF
S~FO~, FLORIDA:
SECTION 1:
That part of a 10.00 foot wide Drainage and ~'~
Utility Easement in Lot 154, BR~VEN FIRST
REPLAT recorded in Plat Book 39, Pages 20 and 21,
Public Records of Seminole County, Florida, being
more particularly described as follows:
Co~ence at the N. E. corner of said Lot 154,
thence S 00~02'58'' E, 10.00 feet along the East
line of said Lot 154 to the South line of said
10.00 foot wide Drainage and Utility Easement;
thence S 89°57'12'' W, 35.00 feet along the South
line of said Easement for a Point of Beginning;
thence continue S 89°57'02'' W, 43.00 feet along
said South line; thence N 00°02'58'' W, 0.50 foot;
thence N 89o57'02" E, 43.00 feet; thence S
00°02'58" E, 0.50 foot to the Point of Beginning.
be and the same is hereby closed, vacated and abandoned.
SECTION 2: If any section or portion of a section of this
ordinance proves to be invalid, unlawful or unconstitutional, it shall
not be held to impair the validity, force or effect of any other
section or part of this ordinance.
SECTION 3: That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby revoked.
SECTION 4: That this ordinance shall become effective
immediately upon its passage and adoption.
