Approve the proposed amendment to the Sanford Airport Authority's (SAA) FY 2022/2023 Capital Budget, increasing the previously approved `Maintenance Facility Redevelopment' project by $563,448. B. Acceptance of the right-of-way donation from Harvest Time International, Inc., for an additional 15 foot right-of-way along the south right-of-way on Narcissus Avenue as required by the City's Land Development Regulations for deficient right- of-way for development purposes. C. Approval of procurement of services to Carr and Collier, Inc., in the amount of $89,120 for East State Road 46 reclaimed water main emergency pipe repair. D. Approve to purchase Virgin Granular Activated Carbon material for the Auxiliary Water Treatment Plant, in the amount of $69,600 from Calgon Carbon Corporation. E. Approve the special event permit, with a noise permit, for the `Anniversary Iglesia di Dios Reconciliasion Nuevo Pacto' from 7 — 9:30 PM, on Saturday, February 25, 2023. F. Approve the special event permit, with a noise permit and an alcohol permit, for the `1st Gran Bailazo Regional Mexicano Sanford 2023', from 3 — 10 PM, on Sunday, March 18, 2023. Approve the special event permit, with an alcohol permit, for the `Lao New Year Festival', from 8 AM — 8 PM on Saturday, April 15, 2023 and Sunday, April 16, 2023. H. Approve the special event permit for the `Texas Roadhouse School's Out Bash', from 5 — 8 PM on Tuesday, May 23, 2023 in the west portion of the parking lot of the Texas Roadhouse located at 100 Towne Center Boulevard, Sanford. I. Approve the special event permit, for `TNT Firework Sales', from Tuesday, June 20, 2023 through Thursday, July 6, 2023, at the Walmart parking lot located at 3653 Orlando Drive daily from 9 AM — 9 PM. J. Approve the special event permit, with a noise permit and an alcohol permit, for the `6th Annual Sanford Jazz in the Park', from 2 — 7 PM on Saturday, October 21, 2023, with street closures from 9 AM — 9 PM. K. Approve the special event permit for the `Trunk or Treat', from 5 — 8 PM on Tuesday, October 24, 2023 in the west portion of the parking lot of the Texas Roadhouse located at 100 Towne Center Boulevard, Sanford. L. Approve the special event permit for the `Texas Roadhouse Christmas Family Fun Festival', from 5 — 8 PM on Tuesday, December 19, 2023 in the west portion of the parking lot of Texas Roadhouse located at 100 Towne Center Boulevard, Sanford. M. Approve the award of contract RFQ 22/23-07 to Lunz Group for Fire Station #40 for design services. N. Approve the lease purchase of seven (7) new unmarked Fleet Management vehicles CITY COMMISSION MINUTES FEBRUARY 139 2023 REGULAR MEETING in the Police Department, in the amount of $34,466 for the remaining seven (7) of the seventeen (17) Police Investigators. O. Approve the Memorandum of Understanding (MOU) relating to off-duty/extra- duty law enforcement services to provide supplemental law enforcement presence at Sanford Special Events and Community Events. P. Approve a piggyback agreement PBA #22/23-231 to ZHA Incorporated for construction consulting and owner's representation services for various capital facility construction, rehabilitation, renovation and repair projects of the City, by way of example, the new Mayfair Clubhouse, Fire Station #40 and other significant projects. Q. Approval of change order to PO# 38994, in the amount of $158,400, not to exceed a total amount of $531,808.50, for substantial damage assessment by adding 262 addresses in the flood zone that the Federal Emergency Management Agency (FEMA) required for submission. R. Add-on Item: Approval and ratification of the Fire Department Fire Fighter/EMT/Engineer and Fire Fighter/Paramedic Contract (2022-2025) with the Sanford Professional Firefighters, Local 3996 of the International Association of Fire Fighters. First reading of Ordinance No. 4723, creating the City's Wastewater Back -Up Grant Program; Ad published February 19, 2023. [Commission Memo 23-024] Vice Mayor Britton moved to approve Ordinance No. 4723, on first reading, Including the additional information as requested by the Commission, prior to the second reading. Approval to deny the entire waiver of a Code Enforcement Lien, except what is allowed in the Lien Amnesty Program for the Code Enforcement Lien associated with 140 Lakeside Circle; Owners, Rhianna H. and Darren D. Legree. [Commission Memo 23-025] Darren Legree and Tony Raimondo, Director of Development Services, spoke on this item. After a lengthy discussion, Commissioner Austin moved to approve to deny the entire waiver of a Code Enforcement Lien, except for what is allowed in the Lien Amnesty Program for the Code Enforcement Lien associated with 140 Lakeside Circle. This property cross attaches with a property located at 1522 Douglas Avenue and is not eligible for the Lien Amnesty Program at this time; Owners, Miriam Holmes and Darlene Campbell. [Commission Memo 23- 027] Darlene Campbell spoke on this item. [Commission Memo 23-027] Commissioner Austin moved to approve Resolution No. 3113. Approve Resolution No. 3114, to amend the Parks and Grounds budget, in the amount of $18,144, for tree services at the Mayfair Country Club for the damages from Hurricane Ian to A Budget Tree Service, Inc. [Commission Memo 23-028] Commissioner Austin moved to approve Resolution No. 3114. Seconded by Commissioner Mahany and carried by vote of the Commission as follows: Mayor Woodruff Aye Vice Mayor Britton Aye Commissioner Wiggins Aye Commissioner Austin Aye Commissioner Mahany Aye E. Approve Resolution No. 3115, to amend the City's budget, in the amount of $64,340 and approve the procurement of services to Universal Protection Services, LLC D/B/A Allied Universal Security Services, for a security guard in the lobby. [Commission Memo 23-029] After a brief discussion Vice Mayor Britton moved to deny to approve Resolution No. 3115. Due to a lock of a second, the motion failed. Commissioner Austin moved to continue CITY COMMISSION MINUTES FEBRUARY 139 2023 REGULAR MEETING the approval of Ordinance No. 3115 to the February 27, 2023 meeting and suggested the City Manager review the funding percentages with Finance. Seconded by Commissioner Mahany and carried by vote of the Commission as follows: Mayor Woodruff Aye Vice Mayor Britton Aye Commissioner Wiggins Aye Commissioner Austin Aye Commissioner Mahany Aye 9) CITY ATTORNEY'S REPORT Mr. Colbert said it was great to be back and thanked everyone for the thoughts, prayers and flowers. He said a case that impacts the City that has been decided by the 4th District Court of Appeal issued an order. This order may be appealed at the Supreme Court. This information is pending. If the order is not appealed it would become the case law that that governs advertising requirements for Public Hearings. Ordinances require two readings and an advertised public hearing. Sometimes the Commission gets to second reading and public hearing and a decision is not made and the matter is continued. This happened in Jupiter and the decision was made subsequent to that continued public hearing second reading. The applicant was the developer and the applicant appealed that decision to the court on the basis that when the matter was continued there was not a published notice of the next hearing. The court sided with the City of Jupiter and that appealed to the District Court of Appeals. The District Court of Appeals on February 8, 2023, decided that the matter should have been advertised for the continued reading/readings. Mr. Colbert has advised the City Clerk of this matter and the City would be doing more advertising for subsequent hearings. He said the Florida League of Cities was deeply CITY COMMISSION MINUTES FEBRUARY 139 2023 REGULAR MEETING involved with this. 10) CITY CLERK'S REPORT Traci Houchin, City Clerk reminded the Commission there are three vacant positions for the REFI Committee that she has received several applications. The Clerk's Office would provide the applications at the next meeting. 11) CITY MANAGER'S REPORT Mr. Bonaparte thanked the Commission for the flowers while his daughter was in the hospital. 12) CITIZEN PARTICIPATION Lou Smith, resident expressed his frustration and concern with the waste water situation. He suggested the City post an apology on the website to the residents regarding the situation. Bill Marcous, Utility Manager, apologized for the problem. The City is working as hard as possible. Resident from 1903 Palmetto expressed his frustration on the waste water situation. Mayor Woodruff said the parts are on order and would require additional contractual assistance. Commissioner Austin said the parts are on order, however, there are many different issues. Clarence McKnight, resident and employee, said he is frustrated as a crew leader. He expressed how the crews would like to be appreciated. The City does not have enough staff, people are getting hurt and they are exhausted. He expressed how he feels the Commission does not care for the employees. He asked the Commission to come spend a day with them in the field like Mr. Bonaparte did. CITY COMMISSION MINUTES FEBRUARY 13, 2023 REGULAR MEETING John Gassle, resident, said in January the City promised transparency. The residents would like more of the details and timeline regarding the vacuum sewer system. Commissioner Austin directed the residents to the City's website. Kim Leteria-Rossi, resident, expressed concern and defeat regarding the Police Department salaries and the City looking to spend money for a security guard. Chief Smith provided a status of the police department staffing situation. Lorenzo Hawthorne, resident, provided a letter to the Commission and expressed concern regarding the recent development on Lake Mary Boulevard, the intersections not properly lit, concern of the wetlands and the road not bicycle friendly. 13) CITY COMMISSION REPORTS Vice Mayor Britton said leadership needs to do better. She spoke of a recession, a moratorium on development, and the City needs to be pro -active. She would like the City to discuss a Fire Tax. Vice Mayor Britton said if a homeowner is not able to connect to City sewer, the realtors should have that information ahead of time. Vice Mayor Britton wanted to assure that any employee who approaches the podium to speak their mind would not be disciplined after the meeting. Commissioner Wiggins said listening and communication is key. He said there was another shooting in District 2 and strongly suggested the public please attend his Community Meeting next Thursday night. The police department would be there to answer questions and provide information. He has a meeting every 4`n Thursday of the month at 6 PM at the Westside CITY COMMISSION MINUTES FEBRUARY 139 2023 REGULAR MEETING Community Center — Dr. Velma Williams Building. Commissioner Wiggins informed everyone he is having a Community Event on February 25, 2023 from Noon to 4 PM at the Westside Community Center — Dr. Velma Williams Building for all ages Citywide. Commission Mahany informed the public that the Christian Sharing Center in Casselberry is preparing income tax returns free of charge.
