01-30-2023 SM MinutesCITY COMMISSION MINUTES JANUARY 309 2023 SPECIAL MEETING The City Commission of the City of Sanford, Florida, met in Regular Meeting on Monday, January 30, 2023, at 5:00 PM, in the City Commission Chambers, City Hall, and 300 North Park Avenue, Sanford, Florida. Present: Mayor Art Woodruff Vice Mayor Patrick Austin Commissioner Sheena R. Britton Commissioner Kerry S. Wiggins, Sr. Commissioner Patty Mahany Assistant City Attorney Lonnie N. Groot City Clerk Traci Houchin Deputy City Clerk Cathy LoTempio Absent: City Manager Norton N. Bonaparte, Jr. City Attorney William L. Colbert 1) Meeting called to order by Mayor Woodruff at 5:03 PM. CEREMONIAL MATTERS: 2) Legislative Prayer by Commissioner Wiggins 3) Pledge of Allegiance Mr. Groot explained the items to be discussed in tonight's Special Meeting. He said the Commission is only allowed to speak of the items listed on the agenda. Citizen's Participation or Commission Comments are not included on the agenda, these topics would not be allowed to be discussed, unless it pertains to the items listed. Commissioner Britton expressed her concern and request for an additional Special Meeting to discuss additional items prior to the next meeting. SPECIAL BUSINESS OF THE COMMISSION: CITY COMMISSION MINUTES JANUARY 301, 2023 SPECIAL MEETING 4) Water quality matters in reference to the 1,4 dioxane chemicals technical and regulatory issues relating to actions of the Florida Department of Environmental Protection and responsible third parties; authorization to initiate administrative and other potentially necessary proceedings. Jake Varn, Attorney for the City of Sanford Water Quality, said he has been working with the City of Sanford Utilities Department since 2016 regarding water quality. The Florida Department of Environmental Protection is taking action. This is a time sensitive item, requiring the Commission's approval for Mr. Varn to file a petition to the Florida Department of Environmental Protection by February 6, 2023. After a brief discussion, Commissioner Mahany moved to authorize Mr. Varn to file a petition on behalf of the City of Sanford with the Florida Department of Environmental Protection regarding water quality. Seconded by Commissioner Austin and carried by vote of the Commission as follows: Mayor Woodruff Aye Vice Mayor Britton Aye Commissioner Wiggins Aye Commissioner Austin Aye Commissioner Mahany Aye 5) Wastewater vacuum system repairs and related activities; adoption of Resolution No. 2023- 3112, authorizing emergency procurements. Bill Marcous, Utilities Manager, said Bilal Iftikhar, Director of Public Works and Utilities was unable to attend tonight's meeting. The City vacuum system was installed in the late 1980's early 1990's and impacts over 500 customers. This request is to adjust the purchasing regulations so the City can get the parts ordered and begin the overhaul repairs to the vacuum CITY COMMISSION MINUTES JANUARY 30, 2023 SPECIAL MEETING sewer system. He said recent storms are a key factor for the system failures. He said, back in the 1980's there were not many commercial establishments using the system as there are today. This resolution would allow the City to be able to hire contractors familiar with the system to assist the City with the repairs in more efficient manner. Maria Shreve, resident, expressed that she is in support of this item. However, she asked for a detailed plan of who is doing the work, where the parts are coming from, how much money it will take to outsource and a timeline. She indicated that the residents should be able to see a plan on how taxpayer money is spent. Melissa Mingler, resident, asked how much of an area of the City this project would cover. She lives at 15th Street and Park Avenue. She expressed frustration, as she has reported the foul odors coming from her alley for over a month and nothing has been done, and she has not received one call back. Mayor Woodruff said this project is specifically on the vacuum sewer system that is generally located between 2nd Street and 25"' Street and Sanford Avenue and French Avenue. Commissioner Austin asked staff to please meet with Ms. Mingler after the meeting. Elaine Jenkins, resident, asked if Rosalia Drive is on the vacuum system and how long before residents would see improvements. Mayor Woodruff said Rosalia Drive is not located in the area of the vacuum sewer system. The repairs would be one pit at a time and the major improvements would be noticed in approximately six months. He said there is a stormwater project in the Rosalia area that should show improvements in the next year or two. Mr. Marcous assured the Commission the Utilities Department would be very transparent, keeping the Commission and the Public aware of the purchases and timelines. CITY COMMISSION MINUTES JANUARY 309 2023 SPECIAL MEETING Commissioner Austin moved to authorize the City Manager the approval to execute procurements and related activities for the Wastewater vacuum system sewer repairs and the adoption of Resolution No. 2023-3112. Seconded by Commissioner Wiggins and carried by vote of the Commission as follows: Mayor Woodruff Aye Vice Mayor Britton Aye Commissioner Wiggins Aye Commissioner Austin Aye Commissioner Mahany Aye Commissioner Britton requested an additional special meeting. Mayor Woodruff suggested the Commission select two tentative dates prior to the February 13, 2023 Commission meeting. He asked to ensure Mr. Bonaparte would be in attendance.
