2064 ORDINANCE NO. 2064 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING, AND ABANDONING A PORTION OF A NORTH-SOUTH AND A PORTION OF AN EAST- WEST STREET RIGHT-OF-WAY LYING BETWEEN UPSALA ROAD AND CENTRAL PARK DRIVE AND BETWEEN STATE ROAD 46 (WEST 1ST STREET) AND OLD MONROE ROAD; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the owners of that certain real property of a portion of an Unnamed East-West Street right-of-way and a portion of an Unnamed North-South street right-of-way between Upsala Road and Central Park Drive and between SR 46 (West First Street) and Old Monroe Road applied to the City of Sanford, Florida, their application to have said property closed, vacated and abandoned; and WHEREAS, a public hearing was held on September 25, 1989, for consideration and determination as to whether or not the closing, vacating and abandoning of that street should be allowed; and WHEREAS, the City Commission has determined that the closing, vacating and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, and welfare will be promoted by such closing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: Section 1: That a portion of an unnamed East-West Street right-of-way and a portion of an Unnamed North-South street right-of-way between Upsala Road and Central Park Drive and between SR 46 (West First Street) and Old Monroe Road, more particularly described as follows: That portion of Unnamed 30.00 foot right-of- way lying between Lots 18 and 19, and between Lots 18 and 31, Smiths Third Subdivision, as recorded in Plat Book 1, Page 86, of the Public Records of Seminole County, Florida. be and the same is hereby closed, vacated and abandoned. SECTION 2: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked.
