I just wanted to make sure that you understood the siding requirement, because it did not appear that Charlie nor Hank were following the board's direction during the meeting. I don't know why they were confused, because the board did articulate it very clearly. Basically, the new siding may remain on the east elevation, but the south, west, and north elevations are required to have siding that matches the existing original in style, all dimension, profile, texture, and all other visual qualities. The siding must be keyed in so the repair area is not visible as a repair when the work is complete. The board chair signed the Development Orders from the meeting yesterday, so they will be recorded soon. I am sending the permit application back over to the Building Department today, now that we have the signed DO's. I'm communicating this directly to you because I know how time sensitive your project is, and I don't want to see you stuck in a situation where there is a problem in issuing a final at the end of the project due to work that is not performed in compliance with the approval. We can discuss this further if you like, but that is the reason I requested your phone number. The hearing of July 18, 2018 on this application was continued the reason for this continuance being that the Property Owner's current code enforcement status exceeded the scope of work authorized in a current certificate of appropriateness. The Order continuing the matter noted that many similar cases have arisen with resulting code enforcement action and that all applicants are treated equally in that, and other, respects. Requested Development Approval: The applicant has requested Board approval for construction of construction of replacement non -historic windows, construction of a porch on the west elevation, and construction of an addition, 190 square feet in size, on the east elevation relative to property located at 213 Laurel Avenue. Additional Findings: The project is located at 213 Laurel Avenue in the Old Sanford Residential Historic District. The applicant has requested construction of replacement non -historic windows, construction of a porch on the west elevation, and construction of an addition, 190 square feet in size, on the east elevation relative to property located at 213 Laurel Avenue. The Seminole County Property Appraiser lists the year of construction as 1901 with additions in 1950. The Applicant has proposed rehabilitation of the building which will affect all elevations and exterior elements. City staff has approved a Certificate of Appropriateness for Minor Review of many items. However, some items require Major Review by the Board. These items include installation of 23 new wood windows, construction of a new porch roof, and an addition, 190 square feet in size, on the east 2 elevation. Additionally, the Applicant is requesting the Board grant after the fact approval for replacement of original siding with new siding on the south and east elevations, and alterations to the east elevation which include covering of windows and creation of a door. City staff has approved the design of 2 salvaged doors to be installed on the west and east elevations. CONCLUSIONS OF LAW a). Pursuant to Section 8.0 of Schedule "S" of the City's Land Development Regulations as set forth in the Code of Ordinances of the City of Sanford, the Historic Preservation Board has reviewed the proposed Certificate of Appropriateness and all matters relating thereto in accordance with the procedures for altering historic landmarks or structures within historic districts as set forth in Schedule "S". b). Specifically, Schedule "S" states that: 1). Alterations to historic landmarks and contributing structures within a historic district shall be consistent with the design, massing and scale of the existing structure and the surrounding area. The distinguishing original characteristics of an existing contributing building, structure or site shall not be destroyed. If replacement is necessary, the new building feature shall match the feature being replaced in composition, color, texture, proportion, style, profile and other visual qualities. Repair or replacement of missing architectural features shall be based on accurate duplications of features, substantiated by historic, physical, or pictorial evidence rather than on conjectural designs or the availability of different architectural elements as seen on other buildings or structures in the area. Alterations and additions to contributing structures shall be compatible with the color, material, and character of the structure, 3 neighborhood or immediate environment. Resurfacing existing historic landmarks or contributing buildings with new material that is inconsistent with the style of the building or was unavailable when the building was constructed, such as artificial stone, brick veneer, asbestos or asphalt shingles, rustic shakes, and vinyl or aluminum siding, shall be prohibited. In cases where artificial siding is currently in place, its removal is not necessary. An owner may retain the material or remove it. If the material is removed, however, it shall be replaced with historically appropriate materials. When siding which is inconsistent with the style of the house is removed, either from the fagade of a building or to re -open an enclosed porch, the original fagade and the original fenestrations shall be documented prior to the commencement of any rehabilitation construction. The Applicant has proposed retaining, repairing, and restoring concealed original surfaces, features, and design. All siding will match the existing original in dimension, profile, color, style, texture, and other visual qualities. 2). With regard to porches and balconies: i). Porches and porch features that are in good condition or repairable and are in character with the style and period of the building shall be retained. Porches and porch features shall be repaired so they match the original in materials, size and configuration. ii). Replacement of existing porches with a design or materials not in character with the style and period of the building shall be prohibited. iii). Porch flooring shall be wood, tongue and groove, and must match original porch flooring in size, shape, orientation, and texture. iv). Porch flooring shall be oriented perpendicular to the building's fagade, or nW shall match the original orientation. v). Replacement porch flooring shall be keyed in so the repair when completed, is not visible. vi). New porch elements, such as, by way of example only and not as a limitation, balusters and columns brackets, trim, and architectural embellishments shall be compatible with the style and period of the building and shall be substantiated by physical and/or pictorial evidence of the subject property. vii). Porch additions shall have a roof type that is either similar to the existing roof or is in character with the style and period of the building. The original porch was altered and the design of original columns, spindles, and railings is unknown. The drawings submitted with the application provide limited details dimensions, materials, profile, and all other visual qualities) regarding the porch column, spindle, and railing design. 3). With regard to windows and doors: i). Windows, frames, glass, muntins, mullions, sills, lintels and pediments in good condition or repairable and in character with the style and period of the building shall be retained. Window types that are no longer permitted by law, such as jalousies, may be replaced with another style of window that is in character with the style and period of the building. ii). If windows or window details are determined to be irreparable, they may be replaced provided that on the primary facades of contributing buildings, replacement windows shall match the existing original windows in size, configuration, material, design and placement. A window survey and specifications for each window must be 5 submitted with the application. On secondary facades, replacement windows may be of a different design or type provided the windows are consistent with the style of the building. iii). Only when a change is appropriate to the style and period of the building may a window be relocated, enlarged, reduced or introduced. iv). When replacing existing windows that are inappropriate to the style and period of the building, they shall be replaced with new windows that are appropriate to the style and period of the building. v). Windows on additions shall have the same orientation and be of a similar size to the existing or original windows of the principal fagade except if the addition is on the same plane as the existing principal fagade, then the windows of the addition shall match the original windows in orientation, size, materials and configuration. vi). All new windows shall have mullion profiles similar to contributing structures. If single hung or double hung windows are placed in groupings, a four to six inch trim piece shall separate the windows. vii). If a window contains divided lites, true muntins or simulated true -divided lites (where a wood frame is glued to the exterior of the glass with a very high bond VHB) adhesive system) shall be used. If double pane windows are installed, an internal shadow bar shall also be used between the glasses. Inserted or removable grilles and flat grilles that do not replicate the profile and characteristics of the original window are prohibited on the exterior of the window pane. The interior of the window pane may have an inserted or removable grille provided that the grille is not flat and has a profile. viii). Rectangular windows shall be casement and single or double hung; A circular and hexagonal windows may be fixed or pivot. Two original 2 over 2 lite windows remained on the building. However, they were determined by the Applicant to be too deteriorated for rehabilitation. The proposed new windows are wood double hung, 2 over 2 lite, and match the overall design and dimension of the original windows. The Applicant has proposed three diamond shaped windows; 2 in the second floor on the north and south elevations, and one on the second floor east elevation. Additionally, a fixed or pivot window has been proposed for the north elevation addition. c). The proposed work is consistent with the purpose and intent of Schedule S" and complies with the design guidelines in Schedule "S" and is in character with the surrounding Historic District, the required architectural standards, and will not adversely impact the Historic District d). To the extent that a conclusion of law as set forth herein also constitutes a factual finding, then such shall be taken to be so as part of this Development Order. d). The proposed Certificate of Appropriateness is hereby found and determined to comply with the aforestated requirements. e). Additionally, the Certificate of Appropriateness sought is hereby found and determined to be consistent with the City of Sanford Comprehensive Plan and development of the property as proposed would be consistent with and in compliance to applicable land development regulations and all other applicable regulations and ordinances as set forth in the Code of Ordinances of the City of Sanford. ORDER NOW, THEREFORE, IT IS ORDERED THAT: 1). The aforementioned application for a Certificate of Appropriateness is APPROVED subject to the following conditions: a). New windows must be wood, must match existing original in design, dimensions, profile and other visual qualities. b). City staff may field approve the columns, spindles, railings and porch ceiling with the condition that the spindles shall not be base nailed to railings, columns shall have decorative tampered edges. c). The applicant design shall provide to the City, by means of a photograph, which design shall be subject to approval by the City staff. d). Hardware shall not be visible in the construction of these elements. e). The porch ceiling must be tongue and groove board construction. f). The porch floor shall be laid perpendicular to the walls. g). With regard to the siding on the South and East wall where the siding was removed, a sealed letter from a Florida professional engineer shall be provided to the City certifying that the structural integrity of the structure has not been compromised and that it meets the requirements of the Florida Building Code. h). The new siding on the East elevation of the structure may be separated with trim board and the South Elevation side of the structure shall be milled to match and properly keyed in. i). Repairs on the North and West side of the structure shall be milled in to 8 match and keyed in. 0), City staff site visits and code enforcement personnel site visits shall occur during every phase of the project and such visits and requisite approvals must occur before work continues on the structure. If City staff does not approve of the work being accomplished during a field visit work on the project shall cease and the issue will be agendized before the Board for resolution of the issue(s). 2). This Development Order granting approval of a Certificate of Appropriateness touches and concerns the aforedescribed property and is subject to code enforcement action in accordance with the controlling provisions of law. No hardware is to be visible in the construction of these elements and that the porch ceiling must be tongue and groove board and the porch floor must be laid perpendicular to the walls, with regard to the siding on the South and East wall where the siding was removed will require an engineer letter that states the structural integrity has not been compromised and meets the Florida Building Code. The new siding on the East elevation can be separated with trim board and the South Elevation side needs to be milled to match and properly keyed in. The polyurethane foam is produced by combining Icynene Based Seal MDI isocyanate (the A component) and Icynene ProSeal resin (the B component). The products have a shelf life of 12 months when stored in factory -sealed containers at temperatures between 60`F and 85°F (160C and 29°C). The Icynene ProSeal is supplied in one formula for all climates. The attributes of the insulation have been verified as conforming to the requirements of ICC 700-2008 Section 703.2.1.1.1(c) as an air impermeable insulation. Note that decisions on compliance for those areas rest with the user of this report. The user is advised of the project -specific provisions that may be contingent upon meeting specific conditions, and the verification of those conditions is outside the scope of this report. Page 1 of 5 ESR-3500 I Most Widely Accepted and Trusted Page 2 of 5 3.3 Thermal Resistance: Icynene ProSeal and Icynene ProSeal LE insulation has a thermal resistance, R-value, at a mean temperature of 75°F (24°C) as shown in Table 1. 3.4 Air Permeability: Icynene ProSeal and Icynene ProSeal LE insulation, at a minimum 1.4-inch (35.6 mm) thickness, is considered air -impermeable insulation in accordance with 2015 IBC Section 1203.3 and 2015 and 2012 IRC Section R806.5 2009 IRC Section R806.4), based on testing in accordance with ASTM E2178. 3.5 Vapor Permeability: Icynene ProSeal and Icynene ProSeal LE insulation has a vapor jpermeance of less than 1 perm (5.700'" kg/ Pa-s-m ) at a minimum thickness of 1.5 inches (38.1 mm) and may be used where a Class II vapor retarder is required by the applicable code. 3.6 Coatings: 3.6.1 DC 315: DC 315 Coating ES( R-3702), manufactured by International Fireproof Technology, Inc. / Paint to Protect Inc., is a water -based coating supplied in 5-gallon (19 L) pails and 55 gallon (208 L) drums. The coating material has a shelf life of 12 months when stored in factory -sealed containers at temperatures between 507 10°C) and 80°F (27°C). 4.0 DESIGN AND INSTALLATION 4.1 General: Icynene ProSeal and Icynene ProSeal LE must be installed in accordance with the manufacturer's published installation instructions, this report and the applicable code. The manufacturer's published installation instructions and this report must be strictly adhered to, and a copy of the instructions and this evaluation report must be available on the jobsite at all times during installation. 4.2 Application: Icynene ProSeal and Icynene ProSeal LE must be applied using spray equipment specified by Icynene, Inc. The insulation must not be used in areas having a maximum service temperature greater than 180'F (82°C), must not be used in electrical outlet or junction boxes or in contact with rain or water, and must be protected from the weather during and after application. Where Icynene ProSeal and Icynene ProSeal LE is used as an air -impermeable barrier, such as in unventilated attic spaces regulated by IRC Section R806, the insulation must be installed at a minimum thickness of 1.4 inches (35.6 mm). The insulation is applied to the intended thickness, with the first pass being at the maximum thickness set forth in the manufacturer's published installation instructions. Where multiple passes are required, the cure time between each pass is in accordance with the manufacturer's instructions. 4.3 Thermal Barrier: 4.3.1 Application with a Prescriptive Thermal Barrier: Icynene ProSeal and Icynene ProSeal LE spray foam Insulation must be separated from the interior of the building by an approved thermal barrier, such as 1/2-inch- thick (12.7 mm) gypsum board installed using mechanical fasteners in accordance with the applicable code, or an equivalent 15-minute thermal barrier complying with, and installed in accordance with, IBC Section 2603.4 or IRC Section R316.4, as applicable. When installation is within an attic or crawl space as described in Section 4.4, a thermal barrier is not required between the foam plastic and the attic or crawl space, but is required between the insulation and the interior of the building. There is no thickness limit when installation is behind a code - prescribed thermal barrier except as noted in Sections 4.4.2.1. 4.4.2.2 and 4.4.3. 4.3.2 Application without a Prescriptive Thermal Barrier with DC 315 Coating: Icynene ProSeal and Icynene ProSeal LE may be Installed without the 15-minute thermal barrier prescribed in IBC Section 2603.4 and IRC Section R316.4, when the installation is in accordance with this section. The Icynene ProSeal insulation and the DC 315 Coaling may be spray -applied to the interior facing of walls, the underside of roof sheathing or roof rafters, and in crawl spaces, and may be left exposed as an interior finish without a 15-minute thermal barrier or ignition barrier. The thickness of the insulation applied to the underside of the roof sheathing must not exceed 14 inches (356 mm). The thickness of the insulation applied to vertical wall surfaces must not exceed 8 inches (203 mm). The insulation must be covered on all surfaces with DC 315 Coating at a minimum wet film thickness of 24 mils wet (0.61 mm) 116 mils dry (0.41 mm)) at an application rate of 1 gallon 3.8 L) per 66.8 square feet (6.15 MT). The coating must be applied over the Icynene ProSeal insulation in accordance with the coating manufacturer's instructions. ESR-3702 and this report. The coating is applied in one coat with low-pressure airless spray equipment. 4.4 Attics and Crawl Spaces: 4.4.1 Application with a Prescriptive Ignition Barrier: When Icynene ProSeal and Icynene ProSeal LE insulation is installed within attics or crawl spaces where entry is made only for service of utilities, an ignition barrier must be installed in accordance with IBC Section 2603.4.1.6 or IRC Sections R316.5.3 and R316.5.4, as applicable. The ignition barrier must be consistent with the requirements for the type of construction required by the applicable code, and must be installed in a manner so that the foam plastic insulation is not exposed. Icynene ProSeal and Icynene ProSeal LE insulation may be installed in unvented attics In accordance with 2015 IBC Section 1203.3 or 2012 IRC Section R806.5 (2009 IRC Section R806.4). 4.4.2 Application without a Prescriptive Ignition Barrier: Where Icynene ProSeal spray foam is installed in an attic or crawl space without a prescriptive ignition barrier, in accordance with Sections 4.4.2.1 and 4.4.2.2, the following conditions apply: 1. Entry to the attic or crawl space is only for the service of utilities and no storage is permitted. 2. There are no Interconnected attic, crawl space or basement areas. 3. Air in the attic or crawl space is not circulated to other parts of the building. 4. Combustion air Is provided In accordance with IMC Intemational Mechanical Code Section 701. 5. The insulation does not require a code -prescribed ignition barrier or coating. 4.4.2.2 Attic and Crawl Spaces - Coated: The thickness of the foam plastic applied to the underside of the roof sheathing and/or rafters, or the underside of floors, must not exceed 14 inches (356 mm). II, III or IV construction, the assembly must comply with IBC Section 2603.5 and this section, and the Icynene ProSeal and Icynene ProSeal LE insulation must be installed at a maximum thickness as described in Table 2. All construction joints and penetrations are to be completely sealed with Icynene ProSeal or Icynene ProSeal LE Insulation. 5.0 CONDITIONS OF USE The Icynene ProSeal and ProSeal LE spray foam insulation described in this report complies with, or is a suitable altemative to what is specified in, those codes listed in Section 1.0 of this report, subject to the following conditions: 5.1 The product must be installed in accordance with the manufacturer's published installation instructions, this evaluation report and the applicable code. SECTION R401 GENERAL R401.3 Energy Performance Level (EPL) display card (Mandatory). The building official shall require that an energy performance level (EPL) display card be completed and certified by the builder to be accurate and correct before final approval of the building for occupancy. Florida law Section 553.9085, Florida Statutes) requires the EPL display card to be included as an addendum to each sales contract for both presold and nonpresold residential buildings. The EPL display card contains information indicating the energy performance level and efficiencies of components installed in a dwelling unit. The building official shall verify that the EPL display card completed and signed by the builder accurately reflects the plans and specifications submitted to demonstrate code compliance for the building. A copy of the EPL display card can be found in Appendix RD. R402.4 Air leakage (Mandatory). The building thermal envelope shall be constructed to limit air leakage in accordance with the requirements of Sections R402.4.1 through R402.4.5. Exception: Dwelling units of R-2 Occupancies and multiple attached single family dwellings shall be permitted to comply with Section C402.5. All recessed luminaires shall be sealed with a gasket or caulk between the housing and the interior wall or ceiling covering. SECTION R403 SYSTEMS R403.1 Controls. R403.1.1 Thermostat provision (Mandatory). At least one thermostat shall be provided for each separate heating and cooling system R403.1.3 Heat pump supplementary heat (Mandatory). Heat pumps having supplementary electric -resistance heat shall have controls that, except during defrost, prevent supplemental heat operation when the heat pump compressor can meet the heating load. R403.3.2 Sealing (Mandatory) All ducts, air handlers, filter boxes and building cavities that form the primary air containment passageways for air distribution systems shall be considered ducts or plenum chambers, shall be constructed and sealed in accordance with Section C403.2.9.2 of the Commercial Provisions of this code and shall be shown to meet duct tightness criteria below. Duct tightness shall be verified by testing in accordance with ANSI/RESNET/ICC 380 by either individuals as defined in Section 553.993(5) or 7), Florida Statutes, or individuals licensed as set forth in Section 489 105(3)(f), (g) or (i), Florida Statutes, to be "substantially leak free" in accordance with Section R403.3.3. R403.3.2.1 Sealed air handler. Air handlers shall have a manufacturer's designation for an air leakage of no more than 2 percent of the design airflow rate when tested in accordance with ASHRAE 193. R403.3.3 Duct testing (Mandatory). Ducts shall be pressure tested to determine air leakage by one of the following methods: Rough -in test- Total leakage shall be measured with a pressure differential of 0.1 inch w.g. (25 Pa) across the system, including the manufacturer's air handler enclosure if installed at the time of the test. All registers shall be taped or otherwise sealed during the test. 2. Postconstruction test: Total leakage shall be measured with a pressure differential of 0.1 inch w.g. (25 Pa) across the entire system, including the manufacturer's air handler enclosure. Registers shall be taped or otherwise sealed during the test. Exceptions: 1. A duct air leakage test shall not be required where the ducts and air handlers are located entirely within the budding thermal envelope. 2. Duct testing is not mandatory for buildings complying by Section 405 of this code. A written report of the results of the test shall be signed by the party conducting the test and provided to the code official. R403.3.5 Building cavities (Mandatory). Building framing cavities shall not be used as ducts or plenums. R403.4 Mechanical system piping insulation (Mandatory). Mechanical system piping capable of carrying fluids above 105°F (41'C) or below 55°F (13"C) shall be insulated to a minimum of R-3. R403.4.1 Protection of piping insulation. Piping insulation exposed to weather shall be protected from damage, including that caused by sunlight, moisture, equipment maintenance and wind, and shall provide shielding from solar radiation that can cause degradation of the material. Adhesive tape shall not be permitted. R403.5.1 Heated water circulation and temperature maintenance systems (Mandatory). Heated water circulation systems shall be in accordance with Section R403.5.1,1. Heat trace temperature maintenance systems shall be in accordance with Section R403.5.1.2. Automatic controls, temperature sensors and pumps shall be accessible. Manual controls shall be readily accessible. R403.5.1.1 Circulation systems. Heated water circulation systems shall be provided with a circulation pump. The system return pipe shall be a dedicated return pipe or a cold water supply pipe Gravity and thermosiphon circulation systems shall be prohibited. Controls for circulating hot water system pumps shall start the pump based on the identification of a demand for hot water within the occupancy. The controls shall automatically turn off the pump when the water in the circulation loop is at the desired temperature and when there is no demand for hot water. R403.5.1.2 Heat trace systems. Storage water heaters not equipped with integral heat traps and having vertical pipe risers shall have heat traps installed on both the inlets and outlets. External heat traps shall consist of either a commercially available heat trap or a downward and upward bend of at least 3'/2 inches (89 mm) in the hot water distribution line and cold water line located as close as possible to the storage tank. R403.5.6 Water heater efficiencies (Mandatory). R403.5.6.1.1 Automatic controls. Service water -heating systems shall be equipped with automatic temperature controls capable of adjustment from the lowest to the highest acceptable temperature settings for the intended use. The minimum temperature setting range shall be from 100'F to 140'F (38'C to 60'C). R403.5.6.1.2 Shut down. A separate switch or a clearly marked circuit breaker shall be provided to permit the power supplied to electric service systems to be turned off. A separate valve shall be provided to permit the energy supplied to the main burner(s) of combustion types of service water -heating systems to be turned off. Ei R403.5.6.2 Water -heating equipment. Water -heating equipment installed in residential units shall meet the minimum efficiencies of Table C404.2 in Chapter 4 of the Florida Building Code, Energy Conservation, Commercial Provisions, for the type of equipment installed. Equipment used to provide heating functions as part of a combination system shall satisfy all stated requirements for the appropriate water -heating category. Solar water heaters shall meet the criteria of Section R403.5 6 2 1. R403.5.6.2.1 Solar water -heating systems. Solar systems for domestic hot water production are rated by the annual solar energy factor of the system. The solar energy factor of a system shall be determined from the Florida Solar Energy Center Directory of Certified Solar Systems. Solar collectors shall be tested in accordance with ISO Standard 9806, Test Methods for Solar Collectors, and SRCC Standard TM-1, Solar Domestic Hot Water System and Component Test Protocol. Collectors in installed solar water -heating systems should meet the following criteria: 1. Be installed with a tilt angle between 10 degrees and 40 degrees of the horizontal; and 2. Be installed at an orientation within 45 degrees of true south. R403.6 Mechanical ventilation (Mandatory). The building shall be provided with ventilation that meets the requirements of the Florida Building Code, Residential, or Florida Building Code, Mechanical, as applicable, or with other approved means of ventilation including: Natural, Infiltration or Mechanical means. Outdoor air intakes and exhausts shall have automatic or gravity dampers that close when the ventilation system is not operating. R403.6.1 Whole -house mechanical ventilation system fan efficacy. When installed to function as a whole -house mechanical ventilation system, fans shall meet the efficacy requirements of Table R403.6.1. Exception: Where whole -house mechanical ventilation fans are integral to tested and listed HVAC equipment, they shall be powered by an electronically commutated motor. R403.6.2 Ventilation air. Residential buildings designed to be operated at a positive indoor pressure or for mechanical ventilation shall meet the following criteria: 1. The design air change per hour minimums for residential buildings in ASHRAE 62.2, Ventilation for Acceptable Indoor Air Quality, shall be the maximum rates allowed for residential applications. 2. No ventilation or air-conditioning system make-up air shall be provided to conditioned space from attics, crawlspaces, attached enclosed garages or outdoor spaces adjacent to swimming pools or spas. 3. If ventilation air is drawn from enclosed space(s), then the walls of the space(s) from which air is drawn shall be insulated to a minimum of R-11 and the ceiling shall be insulated to a minimum of R-19, space permitting, or R-10 otherwise. R403.7 Heating and cooling equipment (Mandatory). R403.7.1 Equipment sizing. Heating and cooling equipment shall be sized in accordance with ACCA Manual S based on the equipment loads calculated in accordance with ACCA Manual J or other approved heating and cooling calculation methodologies, based on building loads for the directional orientation of the building. The manufacturer and model number of the outdoor and indoor units (if split system) shall be submitted along with the sensible and total cooling capacities at the design conditions described in Section R302.1. This Code does not allow designer safety factors, provisions for future expansion or other factors that affect equipment sizing. System sizing calculations shall not include loads created by local intermittent mechanical ventilation such as standard kitchen and bathroom exhaust systems. New or replacement heating and cooling equipment shall have an efficiency rating equal to or greater than the minimum required by federal law for the geographic location where the equipment is installed. Cooling only equipment shall be selected so that its total capacity is not less than the calculated total load but not more than 1.15 times greater than the total load calculated according to the procedure selected in Section 403.7, or the closest available size provided by the manufacturer's product lines. The corresponding latent capacity of the equipment shall not be less than the calculated latent load. The published value for AHRI total capacity is a nominal, rating -test value and shall not be used for equipment sizing. Manufacturer's expanded performance data shall be used to select cooling -only equipment. This selection shall be based on the outdoor design dry-bulb temperature for the load calculation (or entering water temperature for water -source equipment), the blower CFM provided by the expanded performance data, the design value for entering wet -bulb temperature and the design value for entering dry-bulb temperature. Design values for entering wet -bulb and dry-bulb temperatures shall be for the indoor dry bulb and relative humidity used for the load calculation and shall be adjusted for return side gains if the return duct(s) is installed in an unconditioned space. Exceptions: 1. Attached single- and multiple -family residential equipment sizing may be selected so that its cooling capacity is less than the calculated total sensible load but not less than 80 percent of that load. 2. When signed and sealed by a Florida -registered engineer, in attached single- and multiple -family units, the capacity of equipment may be sized in accordance with good design practice. R403.7.1.2 Heating equipment capacity. R403.7.1.2.1 Heat pumps. Heat pump sizing shall be based on the cooling requirements as calculated according to Section R403.7.1.1, and the heat pump total cooling capacity shall not be more than 1.15 times greater than the design cooling load even if the design heating load is 1.15 times greater than the design cooling load. R403.7.1.2.2 Electric resistance furnaces. Electric resistance furnaces shall be sized within 4 kW of the design requirements calculated according to the procedure selected in Section R403.7.1. R403.7.1.2.3 Fossil fuel heating equipment. The capacity of fossil fuel heating equipment with natural draft atmospheric burners shall not be less than the design load calculated in accordance with Section R403.7.1. R403.7.1.3 Extra capacity required for special occasions. Residences requiring excess cooling or heating equipment capacity on an intermittent basis, such as anticipated additional loads caused by major entertainment events, shall have equipment sized or controlled to prevent continuous space cooling or heating within that space by one or more of the following options: 1. A separate cooling or heating system is utilized to provide cooling or heating to the major entertainment areas. 2. A variable capacity system sized for optimum performance during base load periods is utilized. R403.8 Systems serving multiple dwelling units (Mandatory). Systems serving multiple dwelling units shall comply with Sections C403 and C404 of the IECC—Commercial Provisions in lieu of Section R403. R403.9 Snow melt and ice system controls (Mandatory) Snow- and ice -melting systems, supplied through energy service to the building, shall include automatic controls capable of shutting off the system when the pavement temperature is above 50°F (10°C), and no precipitation is falling and an automatic or manual control that will allow shutoff when the outdoor temperature is above 40'F (4.8°C). R403.10 Pools and permanent spa energy consumption (Mandatory). The energy consumption of pools and permanent spas shall be in accordance with Sections R403.10.1 through R403.10.5. R403.10.1 Heaters. The electric power to heaters shall be controlled by a readily accessible on -off switch that is an integral part of the heater mounted on the exterior of the heater, or external to and within 3 feet (914 mm) of the heater. Operation of such switch shall not change the setting of the heater thermostat. Such switches shall be in addition to a circuit breaker for the power to the heater. Gas -fired heaters shall not be equipped with continuously burning ignition pilots. R403.10.2 Time switches. Time switches or other control methods that can automatically turn off and on according to a preset schedule shall be installed for heaters and pump motors. Heaters and pump motors that have built-in time switches shall be in compliance with this section. Exceptions: 1. Where public health standards require 24-hour pump operation. 2. Pumps that operate solar- and waste -heat -recovery pool heating systems. 3. Where pumps are powered exclusively from on -site renewable generation. R403.10.3 Covers. Outdoor heated swimming pools and outdoor permanent spas shall be equipped with a vapor -retardant cover on or at the water surface or a liquid cover or other means proven to reduce heat loss. Exception: Where more than 70 percent of the energy for heating, computed over an operation season, is from site -recovered energy, such as from a heat pump or solar energy source, covers or other vapor -retardant means shall not be required. R403.10.4 Gas- and oil -fired pool and spa heaters. All gas- and oil -fired pool and spa heaters shall have a minimum thermal efficiency of 82 percent for heaters manufactured on or after April 16, 2013, when tested in accordance with ANSI Z 21 56.
