2028 ORDINANCE NO. 2028 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA AMENDING ORDINANCE NO. 2000 WHICH AMENDED ORDINANCE 1990 OF THE CITY CODE WHICH ESTABLISHED LAND DEVELOPMENT REGULATIONS IN THE CITY TO AMEND SCHEDULE "C", AREA AND DIMENSION REGULATIONS, TO RE-ESTABLISH MINIMUM LIVING AREA REQUIREMENTS FOR ONE- AND TWO-FAMILY DWELLINGS TO PROVIDE A PROCEDURE TO APPLY FOR A REDUCTION FROM 1200 SQUARE FEET TO NOT LESS THAN 1000 SQUARE FEET MINIMUM LIVING AREA IN SR1A ZONES AND FROM 900 SQUARE FEET TO NOT LESS THAN 700 SQUARE FEET MINIMUM LIVING AREA IN SR1 ZONES PROVIDING CERTAIN CONDITIONS ARE MET; PROVIDING A METHOD OF REVIEW BY THE CITY COMMISSION; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City recently enacted Ordinance 1990 establishing land development regulations within the City; and WHEREAS, it has come to the attention of the City Commission that area and dimension requirements for one- and two- family dwellings are insufficient; and WHEREAS, the City Commission desires to re-establish area and dimension requirements for one- and two-family dwellings to their former levels so as to protect property values and the quality of life in existing neighborhoods built pursuant to prior regulations; and WHEREAS, the City Commission has determined it to be in the best interest of the Citizens of the City to re-establish said area and dimension requirements; and WHEREAS, the City Commission has determined it to be in the best interest of the public to move swiftly to protect existing neighborhoods built pursuant to prior regulations; NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: The City Commission adopts the statements above as if fully set forth herein. SECTION 2: That Schedule "C" being the area and dimensional regulations for lots and tracts of Ordinance No. 1990, the Land Development Regulations of the City, be and the same is hereby modified to include area and dimension regulations for one- and two-family dwellings as shown on Exhibit "A" attached hereto and incorporated herein by reference. SECTION 3: That developers may provide information to the City's Administrative Official as described in Exhibit "A" hereof; upon receipt of said information the Administrative Official shall have the authority to approve a reduction in minimum living area subject to the criteria described in Exhibit "A" hereof; and the City Commission reserves unto itself the authority to take final action upon referral as described in Exhibit "A". SECTION 4: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 5: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 6: That this Ordinance shall become effective immediately upon its passage and adoption. PASSED AND ADOPTED this 22nd day of May , A.D. 1989. MAyOR~ ~' ~ Acting.
