2041 ORDINANCE NO. 2041 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING, AND ABANDONING A PORTION OF TAMARIND AVENUE LYING BETWEEN SECOND STREET AND THIRD STREET AND LYING BETWEEN POMEGRANITE AVENUE AND PERSIMMON AVENUE; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. ~' ~ WHEREAS, the owners of that certain real property of a ~ ~ portion of Tamarind Avenue lying between Second Street and Third ~ ~ Street and lying between Pomegranite Avenue and Persimmon Avenue ~ applied to the City of Sanford, Florida, their application to o have said property closed, vacated and abandoned; and ~ WHEREAS, a public hearing was held on June 26, 1989, ~-o ~ for consideration and determination as to whether or not the co e i closing, vacating and abandoning of that street should be coo ~ allowed; and ~ WHEREAS, the City Commission has determined that the o .~ closing, vacating and abandoning of that certain property does 6 ~ not conflict with the Comprehensive Plan of the City of Sanford, ~ Florida, and that the public health, economy, comfort, order, e c convenience, and welfare will be promoted by such closing, vacating and abandoning. ~ NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY ~ × OF SANFORD, FLORIDA: ~ Section 1: That a portion of Tamarind Avenue lying ~ o ~ ~ between Second Street and Third Street and lying between c .~ Pomegranite Avenue and Persimmon Avenue, more particularly ~ '~ described as follows: ~ ~e That portion of Tamarind Avenue lying between and abutting Block 4, Tiers 21 and 22, E.R. ~ Traffords Map of the Town of Sanford, cD according to the plat thereof as recorded in /9 .~ Plat Book 1, Page 116 of the Public Records ~ ~'~ of Seminole County, Florida. CD ~ .2 be and the same is hereby closed, vacated= and abandoned, ~ ~ providing the city hereby reserves a =30' wide east-west easement ~_ ~ across Tamarind Avenue. Said 30' east-west easement more ~ articularly described as follows: A 15 foot utility easement lying 7.5 feet either side of an existing 8" sanitary sewer main, furtherly described as follows: An 8"sanitary sewer main running East-West and lying between 2nd Street and 3rd Street and also being within the right-of-way of Tamarind Avenue, of E.R. Trofford's Town of Sanford according to the plat thereof as recorded in Plat Book 1, Pages 56-64 of the Public Records of Seminole County, Florida. SECTION 2: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 4: That this ordinance shall become effective immediately upon its passage and adoption. PASSED AND ADOPTED this 24th day of JuLY , A.~D. 1989.
