2005 ORDINANCE NO. 2005 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING CHAPTER 2 OF THE CITY CODE BY CREATING ARTICLE XVIII TO ESTABLISH A CEMETERY ADVISORY COMMITTEE; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA THAT CHAPTER 2, ARTICLE XVIII OF THE CITY CODE IS HEREBY CREATED AS FOLLOWS: SECTION 1: CREATED; COMPOSITION; APPOINTMENT OF MEMBERS. There is hereby created and constituted a Cemetery Advisory Committee for the City, which shall consist of Five (5) persons to be appointed and confirmed by the City Commission, one of whom shall be the Director of Parks and Recreation. SECTION 2: TERMS; ORGANIZATION; OFFICERS; MEETINGS. The members of the Cemetery Advisory Committee created by this article shall be appointed for a term of three (3) years; one (1) of the initial Cemetery Advisory Committee members shall be appointed for a term of three (3) years, one (1) of the initial Cemetery Advisory Committee members shall be appointed for terms of two (2) years, and two (2) of the initial Cemetery Advisory Committee members shall be appointed for the term of one year; thereafter, the terms shall be three (3) years. No member except the Director of Parks and Recreation shall serve for more than two (2) consecutive three-year terms or parts thereof. Immediately upon appointment, the members of the Cemetery Advisory Committee shall meet and organize and shall elect from among the membership a chairman, a vice-chairman and a secretary, whose terms of office shall be for the period of one year or until their successors are elected by the members of the Cemetery Advisory Committee. The Cemetery Advisory Committee shall conduct such meetings as may be necessary to properly perform its duties and functions and shall establish rules or bylaws to govern the manner in which its meetings and affairs are conducted. SECTION 3: DUTIES; EXPENDITURES. (a) The Cemetery Advisory Committee is empowered and directed to consider and study the Sanford Municipal Cemetery at Lakeview and the First and Second Addition to Evergreen, and shall advise, counsel and consult with the City Commission and the City Manager in connection with the Sanford Municipal Cemetery. The Cemetery Advisory Committee shall consider all matters submitted to it by the City Commission or the City Manager, and shall offer suggestions and recommendations on its own initiative in regard to the operation of the Sanford Municipal Cemetery. (b) The members of the Cemetery Advisory Committee shall receive no compensation and may spend only such sums as may be authorized and appropriated by the City Commission. (c) The Cemetery Advisory Committee shall recommend to the City Commission such overall projects as seem warranted, but shall not concern itself with the day-to-day affairs of normal city functions. SECTION 4: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 5: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked.
