1969 CI~CUIT COU~ F ~C,O~,O & VERIFIED $.llINOLE COUJ~T~ FL. 5 ~ ~ ~ 5 8 1988 ~P 22 ~ I!: 06 ORDINANCE NO. 1969 .~ ~ AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ~ CLOSING, VACATING, AND ABA~ONING A PORTION ~ OF THAT CERTAIN STREET LYING BET~EN VACATED ' ~ SEABO~D COASTLINE RAILRO~ RIGHT-OF-WAY A~ ~ ~ST 16~ STREET A~ BET~EN KEN~L RO~ AND ~ BEVIER RO~ PROVIDING FOR SE~RABILITY, CONFLICTS A~ EFFECTI~ DATE. ~EREAS, the owners of that certain real property abutting that certain street lying between vacated Seaboard Coastling Railroad Right-of Way and West 16th Street and between Kennel Road and Bevier Road, applied to the City of Sanford, Florida, their application to have said property closed, vacated and abandoned; and ~EREAS, a public hearing was held on August 22, 1988, for consideration and determination as to whether or not the closing, vacating and abandoning of that alley should be allowed; and ~EREAS, the City Co~ission has determined that the closing, vacating and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, and welfare will be promoted by such closing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: Section 1: That a street lying between vacated Seaboard Coastline Railroad Right-of-Way and West 16th Street and between Kennel Road and Bevier Road, more particularly described The thirty (30) foot unn~ed road right-of- way lying between Block 26 and Block 39 in the M. M. Smith's Subdivision, Sanford, Florida as recorded in Plat Book 1, Page 55 of the Public Records of Seminole County, Florida; be and the s~e is hereby closed, vacated and abandoned. -i- Ordinance No. 1969 SENW~E CO. FL, this ordinance proves to be invalid, unlawful or unconstitu- tional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and the s~e are hereby revoked.
