1962 EMERGENCY ORDINANCE 1962 AN EMERGENCY ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ESTABLISHING A SIXTY DAY MORATORIUM ON ALL TRANSPORTATION IMPACT FEES: PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATES. WHEREAS, an emergency exists because Seminole County has appealed the Final Summary Judgment entered in Seminole County v. City of Sanford, Case No. 87-2787-CA-17-L, which held that pursuant to Article VIII, Section l(f) of the Florida Constitution the City of Sanford has authority to pass a moratorium on the imposition of County Road Impact Fees within the municipal limits of the City of Sanford, Florida. WHEREAS, Seminole County Ordinance No. 87-4 imposes transportation impact fees on new construction within the municipal limits of the City of Sanford thereby affecting the property interests of the citizens of Sanford. WHEREAS, the City Commission of the City of Sanford, Florida, has determined it to be in the best interest of citizens of the City of Sanford, Florida that a sixty-day emergency moratorium on all transportation impact fees be immediately implemented by the City. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: Emergency Ordinance. That this ordinance is adopted pursuant to the procedures in Section 2.14 of the Charter of the City of Sanford. That the information contained in the whereas clauses of this Emergency Ordinance is true and correct and is incorporated herein as though fully restated. SECTION 2: MORATORIUM. That a moratorium of sixty-days is hereby placed upon all transportation impact fees within the municipal limits of the City of Sanford, Florida. During said "1'- Emergency Ordinance moratorium there shall not be imposed or collected any transportation impact fees on any piece of real property or residential or commercial building within the municipal limits of the City of Sanford, Florida. SECTION 3: SEVERABILITY. If any section or portion of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 4: CONFLICTS. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 5: EFFECTIVE AND EXPIRATION DATES. That this Emergency Ordinance and the moratorium set herein shall take effect immediately upon the Emergency Ordinance's passage and expire sixty(60) days from the date of passage.
