1958 ORDINANCE NO. 1958 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ENDING CHAPTER 19, PLUMBING, SANFORD CITY CODE TO PROHIBIT THE USE OF LEAD PIPES, SOLDER AND FLUX AND AMENDING CHAPTER 28, WATER, SEWER AND SEWAGE DISPOSAL, SANFORD CITY CODE, TO REQUIRE THE CITY OF SANFORD, FLORIDA, TO PROVIDE NOTICE TO PERSONS WHO MAY BE AFFECTED BY CONTAMINATION OF CITY DRINKING WATER, PROVIDING FOR SEVERBALITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City of Sanford, Florida, intends to adopt the 1986 Amendments to the Federal Safe Drinking Water Act, Section 1417; and WHEREAS, said Amendments prohibit the use of lead pipes, solder and flux; and WHEREAS, said Amendments requires all water utilities to provide notice to the public about possible contamination of tapwater; and WHEREAS, the City of Sanford, Florida, intends to comply with the Florida Safe Drinking Water Act, Section 403.850 of the Florida Statutes. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: Chapter 19, Plumbing, Article I, Section 19-3. Amendments to Code, of the Sanford City Code, shall be amended as follows: Section 6021, entitled "Caulked Joints", Section 602.3, entitled "Wiped Joints", Section 602.4, entitled "Soldered Joints" and Section 602.10, entitled "Burned Lead Joints" of Chapter 6 of the Standard plumbing Code and Section 1201.1, entitled "Portable Water", Section 1205.1, entitled "Materials Underground", Section 1208.1, entitled "Selection of Materials" and Section 1210.1, entitled "Materials" of Chapter 12 of the Standard plumbing code are hereby amended to include the '1- Ordinance No. 1958 following: Any pipe, solder, or flux, which is used after June 1988, in the installation or repair of any public water system or any plumbing in a residential or nonresidential facility providing water for human consumption which is connected to a public water system, shall be lead free as described in this section. For purposes of this section, the term "lead free" when used with respect to solders and flux refers to solders and flux containing not more than 0.2 percent lead, and when used with respect to pipes and pipe fittings refers to pipe and pipe fittings containing not more than 8.0 percent lead. SECTION 2: Chapter 28, Water, Sewers and Sewage Disposal. Article II, Section 28-35 is hereby added as follows: Section 28-35. Public Notice Requirements (a) The City's public water system shall identify and provide notice to persons that may be affected by lead contamination of their drinking water where such contamination results from either or both of the following: (1) The lead content in the construction materials of the public water distribution system. (2) Corrosivity of the water supply sufficient to cause leaching of the lead. The notice shall be provided in such manner and form as may be reasonably required by the Administrator of the Environmental Protection Agency. Notice under this paragraph shall be provided notwithstanding the absence of a violation of any national drinking water standard. (b) Notice under this paragraph shall provide a clear and readily understandable explanation of-- (1) the potential sources of lead in the drinking water, (2) potential adverse health effects, -2- Ordinance No. 1958 (3) reasonable available methods of miti- gating kno~ or potential lead content in drinking water, (4) any steps the system is taking to mitigate lead content in drinking water, and (5) the necessity for seeking alternative water supplies, if any. (c) Other Notices shall be provided by the City in such manner and form as may be reasonably required by Federal or State environmental agencies. SECTION 3: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitu- tional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 4: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 5: That this ordinance shall become effective i~ediately upon its passage and adoption.
