CLOSING, VACATING, AND ABA~ONING A PORTION
OF THAT CERTAIN NORTH/SOUTH ~LEY LYING
BET~EN ~ST 10TH STREET ~D ~ST llTH STREET
AND LYING BET~EN MULBERRY A~NUE AND
JESSMINE AVENUE; PROVIDING FOR SE~RABILITY,
CONFLICTS AM EFFECTI~ DATE.
~EREAS, the o~ers of that certain real property
abutting a North/South alley lying between West 10th Street and
West llth Street and lying between Mulberry Avenue and Jess~ine
Avenue, applied to the City of Sanford, Florida, their
application to have said property closed, vacated and abandoned;
and
~EREAS, a public hearing was held on May 23, 1988, for
consideration and determination as to whether or not the closing,
vacating and abandoning of that alley should be allowed; and
~EREAS, the City Co~ission has determined that the
closing, vacating and abandoning of that certain property does
not conflict with the Comprehensive Plan of the City of Sanford,
Florida, and that the public health, economy, comfort, order,
convenience., and welfare will be promoted by such closing,
vacating and abandoning.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY
OF SANFORD, FLORIDA:
Section 1: That a North/South alley lying between West
10th Street and West llth Street and lying between Mulberry
Avenue and Jessamine Avenue, more particularly described as
follows:
A 14 foot alley lying between Lots 1 through
14 in Block 1, Meisch's Subdivision,
according to the plat thereof as recorded in
Plat Book 3, Page 84 of the Public Records of
Seminole County, Florida;
be and the same is hereby closed, vacated and abandoned~
providing the city hereby reserves a utility easement over said
property.
SECTION 2: If any section or portion of a section of
