SENINOLE CO, FL. 5 11~ 5 G G B88 JUH 15 P~ 2:32 ORDINANCE NO. 1939 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING, AND ABANDONING A PORTION OF PARK AVENUE LYING BETWEEN 25TH STREET (SR 46 ) AND 24TH STREET; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the owners of that certain real property a portion of Park Avenue lying between 25th Street (SR 46) and 24th Stret, applied to the Cityof Sanford, Florida, their application to have said property closed, vacated and abandoned; and WHEREAS, a public hearing was held on May 9, 1988, for consideration and determination as to whether or not the closing, vacating and abandoning of that easement should be allowed; and WHEREAS, the City Commission has determined that the closing, vacating and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, and welfare will be promoted by such closing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: Section 1: That a portion of Park Avenue lying between 25th Street (SR 46) and 24th Street, more particularly described as follows: Beginning at the Southwest corner of Lot 18, TEAGUE'S ADDITION as recorded in PB 4, PG 2 of the Public Records of Seminole County, Florida; thence run N 89o46'56'' W along the Westerly extension of the South line of said Lot 18 for a distance of 4 feet; thence run N 00o01'08" E along a line parallel with and 4 feet West of (when measured at right angles) to the West line of Lots 15 through 18 of said TEAGUE ' S ADDITION for a distance of 201.0 feet, thence run S89o46'56" E along the Westerly extension of the North line of Lot 15 of said TEAGUE'S ADDITION for a distance of 4 feet, thence run S00°01'08'' W along said distance of 201.0 feet to the Point of West line of Lots 15 through 18 for a Beginning. be and the same is hereby closed, vacated and abandoned providing that the City hereby reserved a utility easement over said property. SECTION 2: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitu- tional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked.
