ORDINANCE N0. 1840 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING, AND ABANDONING A PORTION OF A UTILITY EASEMENT LYING AT THE SOUTHWEST CORNER OF THE INTERSECTION OF ORLANDO DRIVE (U. S. HIGHWAY 17 & 92) AND DESOTO DRIVE; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the owners of that certain real property abutting that portion a utility easement lying at the Southwest corner of the intersection of Orlando Drive (U. S. Highway 17 & 92) and DeSoto Drive, applied to the City of Sanford, Florida, their application to have said property closed, vacated and abandoned; and WHEREAS, a public hearing was held on September 22, 1986, for consideration and determination as to whether or not the closing, vacating and abandoning of that certain portion should be allowed; and WHEREAS, the City Commission has determined that the closing, vacating and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and ~hat the public health, economy, comfort, order, convenience, and welfare will be promoted by such closing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: Section 1: That a portion of a utility easement lying at the Southwest corner of the intersection of Orlando Drive (U. S. Highway 17 & 92) and De~oto Drive, more particularly described as follows: From the Southeast corner of Lot 27 4th Section Dreamwold, as recorded in Plat Book 4, Page 99, of the Public Records of Seminole County, Florida, run N 31°48'31" E 50.25 feet along the Westerly right-of-way line of U. S. Highway 17 & 92 to the Point of Beginning; thence run N 00°20'13"W 10.00 feet along the Easterly line of said Lot 27; thence run Northwesterly 177.45 feet along the Easterly line of Lots 25, 26 & 27, said 4th Section Dreamwold and the arc of a curve concave Southwesterly having a radius of 215.00 feet, a central angle of 47o17'24" and a chord of 172.46 feet that bears N 28o49'46'' W; thence run Northwesterly 35.64 feet along the North- easterly line of Lot 24, said 4th Section Dreamwold and the arc of a curve concave Southwesterly having a radius of 280.00 feet, a '- central angle of 7°17'24" and a chord of 35.62 ~ --2-- feet that bears N 51°41'51" W; thence run Easterly 71.20 feet along the arc of a curve concave Northerly having a radius of 100.00 feet, a central angle of 40°47'37'' and a chord of 69.70 feet that bears S 77o44'27'' E; thence run Easterly 8.62 feet along the arc of a curve concave Southerly having a radius of 20.00 feet and a central angle of 24o42'06"; thence run S 71°26'09"E 69 52 feet; thence run Southeasterly · 72.08 feet along the arc of a curve concave Southwesterly having a radius of 40.00 feet and a central angle of 103o14'40"; thence run S 31°48'31"W 98.76 feet along the Westerly right- of-way line of U.S. Highway 17 & 92 to the Point of Beginning, containing 0.2277 acres more or less; be and the same is hereby closed, vacated and abandoned, SECTION 2: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 4: That this ordinance shall become effective immediately upon its passage and adoption· PASSED AND ADOPTED this 28th day of October , A .D. 1986.
