ORDINANCE NO. 1882 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING AND ABANDONING ANY RIGHT OF THE CITY AND THE PUBLIC IN AND TO A PORTION OF MULBERRY AVENUE LYING BETWEEN WEST 6TH STREET AND SEABOARD COASTLINE RAILROAD RIGHT- OF-WAY RESERVING A 15 FOOT NORTH/SOUTH UTILITY EASEMENT ALONG AN EXISTING SANITARY SEWER LINE; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the owners of that certain real property a portion of Mulberry Avenue lying between West 6th Street and Seaboard Coastline Railroad right-of-way reserving a 15 foot utility easement on the North South boundary, applied to the City of Sanford, Florida, their application to have said property closed, vacated and abandoned; and WHEREAS, a public hearing was held on September 28, 1987, for consideration and determination as to whether or not the closing, vacating and abandoning of that certain portion should be allowed; and WHEREAS, the City Commission has determined that the closing, vacating and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, and welfare will be promoted by such closing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That a portion of Mulberry Avenue lying between West 6th Street and Seaboard Coastline Railroad right-of- way, further described as follows: Mulberry Avenue lying between West 6th Street and the SCL RR ROW, and abutting Lot 1, Block 8, Tier 19 and Lot 5, Block 8, Tier 20, Seminole Park, PB 2, Pg 75, Seminole County Records. be and the same is hereby closed, vacated and abandoned, reserving, however, unto the City of Sanford, Florida, a 15' utility easement on the North South boundary thereof. SECTION 2: If any section or portion of a section of S~41NGLK C0.
