LE 'UJ Y .... t} 3 3 3 J G m7 AUG 28 PM 3:39 ORDINANCE N0. 1878 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING, AND ABANDONING A PORTION OF A DRAINAGE EASEMENT LYING BETWEEN SANORA ~ ' ~::~ SUBDIVISION AND CORNWALL ROAD AND BETWEEN SANORA SOUTH SUBDIVISION AND SCL RR ROW; __ m PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the owners of that certain real property abutting drainage easement lying between Sanora Subdivision and Cornwall Road and between Sanora South Subdivision and SCL RR ROW, applied to the City of Sanford, Florida, their application to have said property closed, vacated and abandoned; and WHEREAS, a public hearing was held on August 10, 1987, for consideration and determination as to whether or not the closing, vacating -and abandoning of that easement should be allowed; and WHEREAS, the City Commission has determined that the closing, vacating and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, and welfare will be promoted by such closing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: Section 1: That a drainage easement lying between Sanora Subdivision and Cornwall Road and between Sanora South Subdivision and SCL RR ROW, more particularly described as follows: A 60 foot drainage outfall easement 30 feet left and right of the following described centerline: From the Southwest corner of the Northwest Quarter of Section 7, Township 20 south, Range 31 East, run N 89° 59'12" E, a distance of 57.10 feet; thence N O0° 05' on the centerline of Stenstrom Blvd.; thence N 89° 59'12" E, along said centerline, a distance of 575.65 feet for a Point of Beginning; said point being N 00°00'49'' W, a distance of 30.00 feet from the Northeast corner of Lot 25, Sanora South Unit One, as recorded in Plat Book 19, Pages 76 and 77, Public Records of Seminole County, Florida; thence continue N 89°59'12'' E, a distance of 792.70 feet to the point of curvature of a curve concave to the Northwest, having a radius of 488.83 feet and a central angle of ~ cO 38°00'10"; thence Northeasterly along the arc of said curve, a distance of 252.77 feet to a point of tangency; thence N 58° 59'02" E, a distance of 360.06 feet; thence N 70°00'00'' E, a distance of 321.12 feet to the end of said easement, being a point of intersection ~,~ with the Westerly Right of Way line of the Seaboard Coast Line Railroad, less the easterly 150 ft. of the above described property. With respect to the said easterly 150 feet of said property, the 80 ft. drainage outfall easement shall be reduced to a 12 ft. easement, 6 ft. left and 8 ft. right of the center line described above. be and the same is hereby closed, vacated and abandoned. SECTION 2: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitu- tional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 8: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 4: That this ordinance shall become effective immediately upon its passage and adoption. PASSED AND ADOPTED this 24th day of August , A.D. 1987.
