1874 ORDINANCE NO. 1874 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING THE FIREFIGHTERS' RETIREMENT SYSTEM; PROVIDING FOR THE BOARD OF TRUSTEES TO HAVE SOLE AND EXCLUSIVE ADMINISTRATION AND RESPONSIBILITY AND DELETING THE MAYOR AS ONE OF THE DESIGNATED MEMBERS OF THE BOARD; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, the City of Sanford, Florida Firefighters' Retirement System is participating in the premium tax refund program set forth in Chapter 175, Florida Statutes; and WHEREAS, certain amendments to Chapter 175, Florida Statutes, have been enacted which change the requirements for membership on the Board of Trustees of the System. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1. That Section 8, Paragraph 1, of Ordinance No. 1689 be amended to read as follows: "1. The sole and exclusive administration and responsibility for the proper operation of the Retirement System and for making effective the provisions of Ordinance No. 1689 and this Ordinance are hereby vested in a Board of Trustees which shall be designated as the Plan Administrator for the System. The Board shall consist of five (5) persons as follows: A. Two legal residents of the City who shall be appointed by the City Commission to serve for a period of 2 years unless sooner replaced by the City Commission. An appointed Member may succeed himself or herself. A City official, who is otherwise eligible for appointment to the Board of Trustes, shall not be disqualified from consideration solely on the basis of his or her official status. B. Two Employee Members of the Fire Department to be elected as hereinafter provided; and C. A fifth member, elected by the other four (4) members of the Board, to be appointed by the City Commission as a ministerial duty for a two (2) year term. Such fifth member shall be allowed to succeed himself or herself in office for additional two (2) year terms if re-elected." SECTION 2: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitu- tional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION S: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 4: That this ordinance shall become in full force and effect in accordance with the Charter of the City of Sanford, Florida, but shall apply as of October 1, 1988.
