1868 ORDINANCE NO. 1868 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING SCRIVENER'S ERRORS IN ORDINANCE NO. 1859, ARTICLE V OF CHAPTER 6 - BUILDINGS, OF CITY CODE (FLOOD INSURANCE), AS FOLLOWS: PAGE 17, SECTION 6-71, B.; PAGE 18, SECTION 6-71, B. (2); PAGE 20, SECTION 6-71, C. (2); PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, Ordinance No. 1859, Flood Damage Prevention, was passed by the City Commission of the City of Sanford, Florida, on March 23, 1987; WHEREAS, scrivener's errors have been discovered in the original Ordinance 1859; NOW, THEREFORE BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION i: That "Section 6-71. Provisions for Flood Hazard Reduction. B. Specific Standards. In all areas of special flood hazard where base flood elevation data have been provided, as set forth in Section 6-69(B), or Section 6- 70(C)(11), the following provisions are required:" BE DELETED AND REPLACED WITH: "Section 6-71. Provisions for Flood Hazard Reduction B. Specific Standards. In all areas of special flood hazard where base flood elevation data have been provided, as set forth in Section 6-69(B), or Section 6-70(C)(9), the following provisions are required:" SECTION 2: That "Section 6-71. Provisions for Flood Hazard Reduction. B. Specific Standards. (2) Non-Residential IConstruction. New construction or substantial improvement of any commercial, industrial, or non-residential structure shall have the lowest floor, including basement, elevated no lower than one (1) foot above the level of the base flood elevation. Structures located in all A-zones may be flood-proofed in lieu of being elevated provided that all areas of the structure below the required elevation are water tight with walls substantially impermeable to the passage of water, and use structural components having the capability of resisting hydrostatic and .yl110140002t652110355 hydrodynamic loads and the effect of buoyance. A registered profession engineer or architect shall certify that the standards of this subsection are satisfied. Such certification shall be provided to the official as set forth in Section 6-70(B)(3)." BE DELETED AND REPLACED WITH: "Section 6-71. Provisions for Flood Hazard Reduction. B. Specific StandardS. BE DELETED AND REPLACED WITH "Section 6-71. Provisions for Flood Hazard Reduction. C. Standards for Streams Without Established Base Flood Elevations and/or Floodways. (2) New construction or substantial improvements of structures shall be elevated or flood-proofed to elevations established in accordance with Section 6-70(C)(9)." Page --2-- SECTION 4: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitu- tional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 5: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 6: That this ordinance shall become effective immediately upon its passage and adoption. PASSED AND ADOPTED this 8th day of June , A.D. 1987.
