ORDINANCE NO. 1782 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AND ABANDONING A PORTION CLOSING, VACATING, OF GEORGIA AVENUE LYING BETWEEN WEST 25TH STREET AND WEST 24TH STREET AND A PORTION OF WEST 24TH PLACE LYING BETWEEN GEORGIA AVENUE AND HARTWELL AVENUE, RESERVING A UTILITY EASEMENT OVER THE WESTERLY I 5 FEET OF SAID PROPERTY; PROVIDING FOR SEVERABILITY, CON- FLICTS AND EFFECTIVE DATE. WHEREAS, the owners of that certain real property abutting that portion of Georgia Avenue lying between West 25th Street and West 24th Street and a portion of West 24th Place lying between Georgia Avenue and Hartwell Avenue, applied to the City of Sanford, Florida their application to have said property closed, vacated and abandoned; and WHEREAS, a public hearing was held on July 8, 1985, for consideration and determination as to whether or not the closing, vacating and abandoning of that certain portion should be allowed; and WHEREAS, the City Commission has determined that the closing, vacating and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, economy, comfort, order, convenience, and welfare will be promoted by such closing, vacating and abandoning. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: Section 1: That a portion of Georgia Avenue lying between West 25th Street and West 24th Street and a portion of West 24th Place lying between Georgia Avenue and Hartwell Avenue, more particularly described as follows: That portion of Georgia Avenue Right-of-Way lying between the North Right-of-Way line of 25th Street (C.R. 46-A) and the South Right- of-Way line of West 24th Street, and That portion of West 24th Place lying between Block 1 and Block 2, 3rd Section Dreamwold, Plat Book 4, Page 70, Public Records of Seminole County, Florida. be and the same is hereby closed, vacated and abandoned, I p~oviding however that the City hereby reserves a utility .easement over the Westerly 15 feet of said property. SECTION 2: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitu- tional, it shall not be held to impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby revoked. SECTION 4: That this ordinance shall become effective immediately upon its passage and adoption. PASSED AND ADOPTED this 26th day of January A.D. 1987.
