Box 1778, San-e'~-.d, FL 32772-1778 0 1599 PG 139 QRDINANCE NO. 1731 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, CLOSING, VACATING, AND ABANDONING A PORTION OF A NORTH-SOI/fH ALLEY LYING BET~i~N WEST 25TH PLACE AND WEST 26TH STROll~ AND BETWEEN OAK AV~qUE AND PARK AV~NTJE RESERVING A UTILITY EAS~qT; PROVIDING SEVERABILITY, CONFLICTS, AND ~'~'ECTIVE DATE. WHEREAS, the owners of that certain real property abutting a portion of a North-South alley lying between West 25th Place and West 26th Street and between Oak Avenue end Perk Avenue, applied to the City of Senford, Florida, their application to have said property closed, vacated, and abandoned; and WHEREAS, a public hearing was held on November 26, 1984, for consideratic~ and determination as to whether or not the closing, vacating, and abaD~oning of that certain portion should be allowed; and WHEREAS, the City C~l~ssion has determined that the closing, vacating, and abandoning of that certain property does not conflict with the Comprehensive Plan of the City of Sanford, Florida, and that the public health, econcTay, ccE0fort, order, convenience and welfare will be promoted by such closing, vacating and abandoning. NOW, THEREFORE, BE IT ~I~AUl~u BY THE P~0PLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: That a portion of a North-South alley lying between West 25th Place and West 26th Street and between Oak Avenue and Park Avenue, more particularly described as follows: That portion of that certain North-South alley lying betwen Lots 285 through 316, Frank L. Wcedruff's Subdivision of Land's South Sanford, Plat Book 3, Page 44, Public Records of Seminole County, Florida. be and the same is hereby closed, vacated, and abandened, providing however that the City hereby reserves a utility easement over said property. SECTION 2: If any section or portion of a section of this ordinance proves to be invalid, unlawful, or unconstitutional, it shell not be held to invalidate or impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict herewith, be and the same are hereby repealed. 1599 PG 397 SECTION 4: That this ordinance shall becc~ne effective in~ediately upon its passage and adoption.
