1677 ORDINANCE NO. 1677 AN EMERGENCY ORDINANCE OF THE CITY OF SANFORD, FLORIDA, IMPOSING A MORATORIUM ON ISSUING BUILDING PERMITS FOR NEW CONSTRUCTION FOR A PERIOD OF SIXTY (60) DAYS; PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE, WHEREAS, the Department of Environmental Regulation of the State of Florida has determined that Ethylene Dibromide (EDB) in water in quantities in excess of 0.1 parts per billion (PPB) is an unacceptable level, and WHEREAS, testing of the City's water supply has disclosed concentrations of EDB in excess of accepted levels, and WHEREAS, during the first fourteen (14) days of December, 1983, water usage in the City water system averaged 4.482 million gallons per day (MGD), and WHEREAS, the City's total capacity to pump water in a 24 hour period in all fifteen City wells is 9.172 MGD, and WHEREAS,the discovery of unacceptable levels of EDB in six of the City's wells reduces the City's actual capacity to 3.409 MGD, approximately 37.169% of normal total capacity and approximately 1.i MGD below anticipated demand for water, and WHEREAS, the capacity of the City to furnish sufficient quantities of water to its citizens has been diminished and the City has determined that a state of emergency exists, The City Commission of the City of Sanford finds that the health, safety and welfare of its citizens is jeopardized by the lack of adequate supplies of water for consumption for drinking, sanitary uses, and fire protection, NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: A moratorium is imposed on issuing building permits for any and all new construction in the City of Sanford and the City Staff is directed to cease issuing said building permits instenter. SECTION 2: If any section or portion of a section of this ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate or impair the validity, force or effect of any other section or part of this ordinance. SECTION 3: That all ordinances or parts of ordinances in conflict herewith, be and the same are hereby repealed. SECTION 4: This ordinance shall be effective immediately upon its passage and adoption and shall continue for a period of sixty (60) days from date of its passage and adoption unless modified or amended by subsequent legislative act of the City Commission.
