1600 ORDINANCE NO. 1600 AN ORDINANCE OF THE CITY OF SANFOR~ FLORIDA, SAID ORDINANCE RELATING TO WATER CONSERVATION; CREATING THE WATER CONSERVATION ORDINANCE; PRO- VIDING THAT, AFTER A SPECIFIED DATE, NO NEW BUILDING OR ADDITION TO OR RENOVATION OF AN EXISTING BUILDING MAY BE BUILT IF IT CONTAINS CERTAIN PLUMBING EQUIPMENT; PROVIDING EXCEP- TIONS; PROVIDING A PENALTY; PROVIDING SEVER- ABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, water is a basic resource; and WHEREAS, it is the declared policy of the City of San- ford, Florida, to promote the conservation, development, and pro- per utilization of surface and ground water; and WHEREAS, rapid development and increasing demand for potable water has placed considerable stress upon these resources; and WHEREAS, the cost and ability to obtain, treat, and distribute drinking water and to collect, treat, and dispose of wastewater are directly related to the cost and availability of energy; and WHEREAS, the use of heated water in the household constitutes a significant energy expenditure; and WHEREAS, water conservation has been declared a national priority and future federal water projects will require water conservation considerations; and WHEREAS, efforts to ensure both environmental pro- tection and long-term economic productivity would be enhanced by water conservation. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1: Short Title - This Ordinance may be cited as the "Water Conservation Ordinance." SECTION 2: After the effective date of this Ordinance, no new building shall be constructed which: A. Employs a tank-type water closet having a tank capacity in excess of 3 1/2 gallons of water; or B. Employs a shower head or faucet that allows a flow of more than an average of 3 gallons of water per minute at 60 pounds of pressure per square inch. SECTION 3: The requirements of Section 2 apply to additions to or renovations of existing buildings only if the cost of the additional or renovation exceeds twenty-five percent of the existing building's value and compliance with the require- ments of this section will not require substantial modification of the existing plumbing system. SECTION 4: In satisfaction of the requirements of this section, the installation of tank-type water closets having a tank capacity in excess of 3 1/2 gallons shall be permitted if such water closets are equipped with a device which reduces average water consumption to no more than 3 1/2 gallons per flush. SECTION 5: The City Manager or his designee may allow the use of standard flush toilets if, in his opinion, the con- figuration of the building drainage system requires a quantity of water greater than 3 1/2 gallons to adequately flush the system. SECTION 6: If any section or portion of a section of this ordinance proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect of any section or part of this ordinance. SECTION 7: That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed.
