1580 ORDINANCE NO. 1580
AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
AMENDING ORDINANCE NO. 1557 WHICH PREVIOUSLY
AMENDED ORDINANCE NO. 1097, ARTICLE II, SECTION
12-1(a), TO EXEMPT HOMjE OCCUPATIONS FROM A PUB-
LIC HEARING ON AN APPLICATION FOR A CONDITIONAL
USE; PROVIDING FOR SEVERABILITY, CONFLICTS AND
EFFECTIVE DATE.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD,
FLORIDA:
SECTION 1: That Ordinance No. 1557, Article II,
Section 12-1(a), which previously amended Ordinance No. 1097,
be and the same'is hereby amended to read as follows:
Article II, Section 12-1(a) Hearing.
Decisions, finding and recommendations of the Plan-
ning and Zoning Commission concerning applications
for a conditional use shall be reached only after
a public hearing and after notice has been given
by certified mail to the applicant and to all pro-
perty owners as last extended on the tax roll with-
in 200 feet of the subject property. In addition,
public notice shall be given by advertising one time
in a newspaper of general circulation at least 10
days prior to the public hearing. Such notice shall
contain the address or location of the subject
property, as well as a brief description of the
nature of the application, provided however, no
public hearing and no fee shall be required for
applications for home occupations as conditional
uses. Applications for conditional use shall be
accompanied by an application fee as set by the
City Commission from time to time. The present
fee is Seventy-Five Dollars ($75.00) until further
action by the City Conunission.
SECTION 2: If any section or a portion of a section
of this Ordinance proves to be invalid, unlawful or unconstitu-
tional, it shall not be held to invalidate or impair the validity,
force or effect of any other section or part of this ordinance.
SECTION 3: That all ordinances or parts of ordinances
in conflict herewith, be and the same are hereby repealed.
SECTION 4: That this Ordinance shall become effective
immediately upon its passage and adoption.
