ORDINANCE NO. 1577
AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
VACATING THAT CERTAIN ALLEY LYING NORTH AND
SOUTH BETWEEN 8TH STREET AND 9TH STREET AND
BETWEEN BAY AVENUE AND MELLONVILLE AVENUE:
RESERVING UNTO THE CITY A UTILITY EASEMENT;
PROVIDING FOR SEVERABILITY, CONFLICTS AND
EFFECTIVE DATE.
WHEREAS, all of the owners of that certain real pro-
perty abutting that certain alley lying North and South between
8th Street and 9th Street and between Bay Avenue and Mellonville
Avenue, applied with the City of Sanford, Florida, their ap-
plication to have said alley vacated; and
WHEREAS, a public hearing was held on August 24, 1981,
for consideration and determination as to whether or not the
vacating of the alley should be allowed; and
WHEREAS, the City Commission has determined that
the vacating of said alley does not conflict with the Comprehen-
sive Plan of the City of Sanford, Florida and that the Public
health, economy, saftey, comfort, order, convenience and welfare
will be promoted by such vacating.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE
CITY OF SANFORD, FLORIDA:
SECTION 1: That certain alley lying North and South
between 8th Street and 9th Street and between Bay Avenue and
Mellonville Avenue, more particularly described as follows:
That certain north south alley in Block
10, Tier H, E.R. Trafford's Map of the
Town of SanfOrd, according to the Plat
thereof as recorded in Plat Book 1, Page
115, of the public records of Seminole
County, Florida;
be and the same is hereby vacated, reserving however, unto the
City an easement for utility purposes.
SECTION 2: If any section or portion of a section of
this Ordinance proves to be invalid, unlawful, or unconstitutional,
it shall not be held to invalidate oE impair the validity, force
or effect of any other section or part of this Ordinance.
SECTION 3: All ordinances or parts of ordinances
in conflict herewith, be and the same are hereby repealed.
SECTION 4: This Ordinance shall become effective
immediately upon its passage and adoption.
