ORDINANCE NO. 1529
AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
VACATING AND ABANDONING THAT CERTAIN UTILITY
EASEMENT SITUATED IN LOTS 12 AND 13, BLOCK Y,
TOWN OF SANFORD, ACCORDING TO PLAT THEREOF
RECORDED IN PlAT BOOK 1, PAGE 113, PUBLIC
RECORDS OF SEMINOLE COUNTY, FLORIDA; PROVIDING
FOR CONFLICTS, SEVERABILITY AND EFFECTIVE DATE.
WHEREAS, an easement was granted on September 5, 1979,
unto the City of Sanford, Florida, by Otto and Pearl McDaniel
for utility purposes for the construction of a sewer line upon
certain real property hereinafter described; and
WHEREAS, it has been determined that the City of San-
ford, Florida, is not in a position to construct the contem-
plated sewer line on the property, and therefore, does not
need the easement,
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE
CITY OF SANFORD, FLORIDA:
SECTION 1: That that certain grant of easement dated
September 5, 1979, between Otto McDaniel and Pearl McDaniel,
be and the same is hereby vacated and abandoned, said ease-
ment being described as follows:
A 20-foot Utility Easement lying in Lots
12 and 13, Block Y, Town of Sanford, accord-
ing to the plat thereof as recorded in Plat
Book 1, page 113 as recorded in the Public
Records of Seminole County, Florida; more
particularly describedas follows: Being 6.57
feet,North of the Northeast corner of the South
1/2 of said Lot 13 for a P.O.B.; said point
also being on the Centerline of a 20-foot
Utility Easement, 10 feet either side of said
Centerline; thence run N.87°49'30"W. along
said Centerline 136.88 feet; thence run S.64°
19'22"W. along said Centerline 80 feet to an
intersection with the Centerline of the exist-
ing sanitary sewer main; thence run Westerly
along said Centerline of the existing sanitary
sewer main to an intersection with the Westerly
Lot line of said Lot 12; said intersection
point being the end of the 20-foot Utility
Easement.
SECTION 2: If any section or portion of a section of
this Ordinance proves to be invalid, unlawful, or unconstitu-
tional, it shall not be held to invalidate or impair the
validity, force or effect of any other section or part of
this Ordinance.
SECTION 3: That all ordinances or parts of ordinances
in conflict herewith, be and the same are hereby repealed.
SECTION 4: This Ordinance shall become effective
immediately upon its passage and adoption.
