1527 ORDINANCE NO. 1527 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING SECTION 22-16 OF CHAPTER 22 OF THE SANFORD CITY CODE, SAID CHAPTER BEING ENTITLED "SIGNS AND ADVERTISING;" SAID AMENDMENT AUTHOR- IZING SIGNS ON BENCHES ON THE PUBLIC RIGHTS OF WAY ONLY UPON SPECIFIC AUTHORITY OF THE CITY COMMISSION, PROVIDING FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE. WHEREAS, Sub-section (c) and (t) of Section 22-16 of Chapter 22 of the Code of the City of Sanford, Florida prohibited bench signs and signs on pubI~c property or public rights-of-way; and WHEREAS, it is the desire of the City Commission to amend the Code in such a manner to allow signs on benches situated on public property and public rights-of-way in certain instances by specific authority of the City Cor~nission, NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SAwNFORD, FLORIDA, AS FOLLOWS: SECTION 1: That Section 22-16 (c) of the Sanford City Code is hereby amended to read as follows: "(c) Bench signs, trash rece tacle signs~ gutter signs, and snipe s~gns as define~in the definitions shall be prohibited, except that bench signs on public prop- erty and public rights-of-way may be authorized upon specific authority by action of the City Commission." SECTION 2: That Section 22-16 (t) of the Sanford City Code is hereby amended to read as follows: "(t) Signs of public property. No person shall erect a sign on or over any public property or public right- of-way except as specifically provided in these regulations, and as provided for as to bench signs in Sub-section (c) hereof. Signs may be erected on public property only by a public body or a semi-public bodXprovided such sign is approved by the city manager. No person shall paint, paste, print or nail any banner sign, paper sign, or any advertisement or notice of any kind whatsoever, or cause the same to be done, on any curb, flagstone, pavement or any other portion or part of any sidewalk or street, or upon any tree, lamp post, telephone or telegraph pole, hydrant or bridge within the limits of any street or public right-of-way withinthe city, provided, however, this section shall not apply to regular notices as required by law to be so posted, and other excep- tions as provided in section 22-15(1)." SECTION 3: If any section or portion of a section of this Ordinance proves to be invalid, unlawful or unconstitu- tional, it shall not be held to invalidate or impair the validity, force or effect of any section or part of this Ordinance. SECTION 4: That allordinances or parts of ordinances in conflict herewith, be and the same are hereby repealed. SECTION 5: This Ordinance shall become effective immed- iately upon its passage and adopt~on. PASSED and ADOPTED this 27th day of October A.D. 1980.
