1398 ORDINANCE NO. 1398 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING SECTION 3-4 OF CHAPTER 3, ENTITLED "ALCOHOLIC BEVERAGES" OF THE SANFORD CITY CODE; SAID AMENDMENT PROVIDING FOR THE 500 FOOT REQUIREMENT TO BE WAIVED AT THE DISCRETION OF THE CITY COMMISSION AFTER NOTICE TO AFFECTED PARTIES AND PUBLIC HEARING. BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1. That Section 3-4 of Chapter 3, entitled "Alcoholic Beverages" of the Sanford City Code is hereby amended to read as follows: Sec. 3-4. NUMBER OF LICENSES LIMITED. Permits and licenses to vendors of intoxicating liquors, except wine and beer° shall not be granted in excess of one (1) permit and license to each fifteen hundred (1,500) persons in the City according to the last census thereof~ s~ate or federal, as the case may be. Permits and licenses to vendors of intoxicating liquors~ including beer and wine for consumption on the premises, shall not be issued to any vendor whose place of business would be located within five hundred (500) feet of an existing place of business of any other vendor of such intoxicating liquors unless waived in the discretion of the City Commission. In the event such vendor applies for a permit and license and it is determined that the vendor's place of business will be within five hundred (500) feet of any other vendor of intoxicating liquors, notice shall be given to any affected vendors within the five hundred (500) foot area by certified mail of a public hearing to be held before the City Commission to determine whether or not such permit and license should be issued, said notice to be given by certified mail at least ten (10) days prior to said public hearing. The applicant shall pay a fee for the expense of conducting said public hearing in an amount to be determined from time to time by the City Commission. The location of all such places of business and permits granted prior to October 10o 1977o shall in no way be affected by this section and are hereby approved; provided further, that any regularly established hotel or motel is the City having twenty-five (25) or more rooms shall be exempt from the provisions of this section. SECTION 2. That all ordinances or parts of ordinances in conflict herewith be, and the same are hereby repealed. SECTION 3.
