1363 ORDINANCE NO. 1363 AN ORDIN~iNCE OF THE CITY OF SANFORDo FLORIDA, A1VLENDING SECTION 12 OF ARTICLE VII OF THE SANFORD CITY CODE~ THE SA1VIE BEING ENTITLED OUTSIDE DISPLAY OF 1VLERCHANDISE AND PRODUCTS, SAID AM END1ViENT AMENDING THE PROVISION FOR THE OUTSIDE DISPLAY OF 1VLERCHANDISE AND PRODUCTS TO PROVIDE FOR DISPLAY IN CO1V~iV~ERCIAL AND INDUSTRIAL DISTRICTS TO BE AT LEAST TEN FEET FROM ANY PROPERTY LINE OF THE BUSINESS PROPERTY OR ANY PUBLIC RIGHT-OF-WAY UPON ~VHICH THE 1ViERCHANDISE OR PRODUCTS AHE SITUATED, AND FURTHER PROVIDING FOR THE DISPLAY OF MERCHANDISE ON PUBLIC SIDE~VALKS PROVIDED THE CLEAR V~IDTH OF PEDESTRIAN TRAFFIC IS NOT REDUCED BELOV~ FIVE FEET. BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1. That Section 12 of Article VII of the Sanford City Code is hereby amended to read as follov~s: Section 1Z. Outside Display' of Merchandise and Products (1) No outdoor sales or display of merchandise or products ~vill be permitted in connection wi~h any permitted or conditional uses authorized in any commercial or industrial district unless said merchandise or products are situated at least ten (10) feet from any property line of the business property or any public right Of way upon ~vhich the merchandise or products are situated~ or unless the merchandise or products are displayed in an enclosure v~hich has received site plan approval in accordance with the general regulations pertaining to site plan approval. (2) V~rhere there are no building setback requirements. merchandise may be displayed on public sidewalks, provided the clear ~vidth of pedestrian traffic area is not reduced belov~ five (5) feet. Existing reductions~ such as landscaping and benches shall be considered as obstructions when computing clear width. · (3) This section shall not apply to the sale of motor vehicles. trailers. mobile homes, boats and other recreational vehicles of a similar nature ~vhich are covered in Section 9 of this Article. (4) The owner or operator of any business covered by the provisions of this section desiring to have the provisions of this section waived for the purpose of a special sale of merchandise or products on a portion of the property within ten (10) feet of a property line or public right of way shall make application to the City Commission for a special sale permit which may be granted in the discretion of the City Commission for a period not to exceed ten (10) days. SECTION 2. That all ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed. SECTION 3.
