1353 ORDINANCE NO. 1353 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, ADOPTING THE STATE OF FLORIDA MUNICIPAL FIREMEN'S PENSION TRUST FUND IN ACCORDANCE WITH THE PROVISIONS OF CHAPTER 175, FLORIDA STATUTES, PROVIDING FOR THE CITY OF SAN FORD TO CONTRIBUTE AN AMOUNT EQUAL TO TEN PERCENT OF THE SALARY OF EACH UNIFORMED FIREMAN WHO IS A MEMBER OF THE SANFORD FIRE DEPARTMENT, ONE-HALF OF SUCH CONTRIBUTION TO BE CREDITED AS A CONTRIBUTION TO THE TRUST FUND BY THE INDIVIDUAL FIREMAN, PROVIDING FOR THE ASSETS OF THE CITY OF SAN FORD FIREMEN'S RELIEF AND PENSION FUND TO BE MAINTAINED LOCALLY, PROVIDING FOR THE MEMBERS OF THE BOARD OF TRUSTEES OF THE FORMER SAN FORD FIREMEN'S RELIEF AND PENSION FUND TO BE THE TRUSTEES OF THE MUNICIPAL FIREMEN~S PENSION TRUST FUND AND TO SERVE IN ACCORDANCE WITH THE REQUIREMENTS OF CHAPTER 175, FLORIDA STATUTES, AND PROVIDING FOR AN EFFECTIVE DATE OF OCTOBER 1, 19~6. WHEREAS, the Legislature of the State of Florida at the regular session of the 1976 Legislature adopted Chapter' 76-484, which said legislative act repealed Chapter 61-2792 and Chapter 65-2437, Laws of Florida; and WHEREAS, the passage of Chapter 76-484, Laws of Florida, abolished the City of Sanford Firemen's Relief and Pension Fund, and as a result of said act the members of the City of Sanford Fire Depart- ment shall be governed by Chapter 175, Florida Statutes, said chapter being entitled Municipal Firemen's Pension Trust Fund; and WHEREAS, it is necessary to pass an OrdLnance ~n order to transfer the assets of the Sanford Firemen's Relief and Pension Fund to the Municipal F[remen's Pension Trust Fund; and WHEREAS, it is the desire of the City Commission of the City of Sanford to contribute an mount equal to ten percent of the salary of each uniformed fireman to the pension trust fund and, further, to provide that one-half of such contribution be credited as a contribution to the trust fund by the individual fireman° NOV~ THEREFORE, BE IT ENACTED BY THE CITY OF SAN FORD, FLORIDA: SECTION 1. That Chapter 175, Florida Statutes, said chapter being entitled "Municipal Firemen's Pension Trust Fund" be and the same ~s hereby adopted. SECTION 2. That the City of Sanford, Florida, shall contribute an amount equal to ten percent of the salary of each uniformed fireman who is a member of the Sanford Fire Department, to the City of Sanford, Florida Municipal Firemen's Pension Trust Fund, and one-half of such contribution shall be credited as a contri- bution to sa~d trust fund by the individual fireman. SECTION 3. That all assets of the City of Sanford Firemen's Relief and Pension Fund shall remain under the jurisdiction of the present trustees of the City of Sanford Firemen's Relief and Pension Fund and said funds shall hereafter be designated as the C~ty of Sanford, Florida Municipal Firemen's Pension Trust Fund. SECTION 4. That the present members of the Board of Trustees of the City of Sanford Firemen's Relief and Pension Fund shall remain in office under the City of Sanford, Florida Municipal Firemen's Pension Trust Fund and their term of service shall be regulated by the provisions of Chapter 175, Florida Statutes. SECTION 5. That all Ordinances or parts of Ordinances in conflict herewith be and the same are hereby repealed. -2- SECTION 6. That this Ordinance shall become effective on Oc~obel~ 1, 1976.
