1298 ORDINANCE NO. 1298
AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
AMENDING ARTICLE VIII~ SUPPLEMENTARY REGULATIONS,
SECTION 6, SITE DEVELOPMENT PLAN, PARAGRAPH 2,
OF THE ZONING ORDINANCE OF THE CITY OF SANFORD,
FLORIDA, SAID AMENDMENT TO REQUIRE THAT SITE
DEVELOPMENT PLANS CONFORM TO ALL APPLICABLE
PROVISIONS OF THE ZONING ORDINANCE AND FURTHER
PROVIDING THAT THE SAFETY AND CONVENIENCE OF THE
PUBLIC ARE PROPERLY PROVIDED FOR AS TO ADEQUATE
OFF-STREET PARKING AND LOADING FACILITIES AND
ADEQUATE PROTECTION AND SEPARATION FOR CONTIGUOUS
AND NEARBY PROPERTY, AND TO FURTHER IMPOSE ADDI-
TIONAL REQUIREMENTS OR CONDITIONS IN THE EVENT THE
.SITE IS WITHIN A PRIME WATER RECHARGE AREA.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA:
SECTION 1. That Article VIII, Supplementary Regulations, Section 6,
Site Development Plan, Paragraph 2 shall be amended to read as follows:
(2) In passing upon and approving such site development
plan, the Planning and Zoning Commission shall consider
the location, size, height, spacing of any building, structure
or use and its appurtenances° access and circulation for
vehicles and pedestrians, streets, parking areas, yards and
open spaces, and relationship to adjacent property. The
Planning and Zoning Commission shall not approve such site
development plan unless it finds that such site development
plan conforms to all applicable provisions of the zoning
ordinances, that the safety and convenience of the public are
properly provided for, that adequate off-street parking and
loading facilities are provides, and that adequate protection
and separation are provided for contiguous and nearby property.
The Planning and Zoning Commission may attach to its approval
of a site development plan any reasonable condition, limitation
or requirement which is found necessary, in its judgment, to
effectuate the purposes of this section and to carry out the
spirit and purposes of the zoning ordinance° including any
special lknitations, requirements, or conditions where the
site is within an area of prime water recharge as designated
by the Sanford Planning and Zoning Commission.
SECTION 2. That all other provisions of said Article not in
conflict herewith shall remain in full force and effect.
SECTION 3. That this ordinance shall become effective immediately
upon its passage and adoption.
