1286 ORDINANCE NO. 1286
AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
AMENDING SECTIONS 22-16 (u), 22-19 (a), 22-19 (d),
AND 22-19 (i), OF THE SANFORD CITY CODE, SAID
SECTIONS BEING PORTIONS OF THE SIGNS AND ADVERTISING
CHAPTER OF SAID CODE; SAID AMENDMENTS DELETING
THE REQUIREMENT FOR APPROVAL OF PLANS AND SITE
LOCATION BY THE PLANNING BOARD; DELETING THE
NECESSITY THAT AMENDMENTS TO THE CHAPTER BE
IN THE SAME MANNER AS PROVIDED FOR AMENDING
THE ZONING ORDINANCE; SUBSTITUTING THE CITY
MANAGER FOR THE BUILDING OFFICIAL AS TO THE
ADMINISTRATION AND ENFORCEMENT OF THE CHAPTER
AND PROVIDING FOR APPEAL TO THE CITY COMMISSION;
SUBSTITUTING THE CITY MANAGER FOR THE BOARD OF
ADJUSTMENT AS TO THE GRANTING OF VARIANCES.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA:
SECTION 1. That Section 22-16 (u) of the Sanford City Code is
hereby amended to read as follows:
"(u) Subdivision signs and development entranceways. Sub-
division signs and entranceways, not exceeding two (2) in number, may be
erected at each entrance to any subdivision for identification purposes
relecting only the name of the subdivision. Such signs and entranceways,
however, shall be erected only after compliance with zoning ordinance
regulations."
SECTION 2. That Section 22-19 (a) of the Sanford City Code is
hereby amended to read as follows:
"(a) Amendments. This article may be amended from time to
time in the same manner as provided for amending other ordinances of the
City of Sanford~ Florida."
SECTION 3. That Section 22-19 (d) of the Sanford City Code is
hereby amended to read as follows:
"(d) Enforcement of other regulations. It shall be the duty of
the building official to administer and enforce the provisions of this article
in conjunction with the building and electrical codes of the city. In case of
a conflict between any of the provisions of this article and those of the
building or electrical code° in a given instance, the more restrictive of the
two (2) shall govern. The City Manager shall review the enforcement of the
provisions of this article and may waive the requirements if he considers such
waiver to be in the best interest of the City and in keeping with the intent of
this ordinance, and in the event of such waiver the City Manager shall report
his action to the City Commission. In the event any party desires to appeal
the enforcement such party shall have a fight to appeal directly to the City
Commission."
SECTION 4. That Section 22~19 (i) of the Sanford City Code is
hereby amended to read as follows:
"(i) Variances. Applications of the regulations may be varied by
the City Manager, where, owing to special conditions, a literal enforcement of
the provisions of this article will, in an individual case, result in practical
difficulty or unnecessary hardship peculiar to property and not people. A
variance is required on all nonconforming signs which have not been removed
within the five (5) year time limitation set forth in these regulations."
SECTION 5. Except as amended herein, said Ordinance as amended
shall remain in full force and effect.
SECTION 6. That this Ordinance shall become effective immediately
upon its passage and adoption.
