1244 ORDINANCE NO. 1244 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING CHAPTER 11, SANFORD CITY CODE OF THE CITY OF SANFORD, FLORIDA, SECTION 11-12 THEREOF, AS AMENDED, SUCH SECTION IMPOSING A FEE FOR THE COLLECTION OF REFUSE AS DEFINED THEREIN PRE- SCRIBING THE AMOUNT OF SUCH FEE AND DEFINING USAGES UPON WHICH SAID FEE IS BASED AND PROVIDING FOR THE METHODS OF BILLING, SAID AMENDMENT CHANG- ING THE FEES FOR REFUSE COLLECTION. BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1. That Section 11-12 of Chapter 11 of the Sanford City Code, be and the same is hereby amended in words and figures in accordance with Schedule I attached hereto and hereby made a part of this Ordinance as fully and completely as though the same were set forth in this Section. SECTION 2. Except as amended herein, said section as amended shall remain in full force and effect. SECTION 3. That this ordinance shall become effec- tive October 1, 1974. SCHEDULE I "Sec. 11-12. Schedule of Refuse Collection Fees There is hereby imposed a refuse collection fee, the term "refuse collection" including collection of both garbage and refuse as defined in Section 11-1 of the Code of the City of Sanford, Florida, 1973, the amount of which fee shall be in accordance with the following schedule: (a) For each single-family residence, which term shall embrace only a single building and its premises for single-family occupancy, and exclude any rental occupancy other than the single-family, each church, each lodge, which term shall embrace only non-profit, fraternal organizations maintaining buildings for their lodge purposes, and each nursery, such term embracing only educational 'buildings used for instruction of children of pre-public school age, the fee to be paid to the City shall be three dollars and ninety-five cents ($3.95) per month with an allowance of not more than two receptacles, as required by Section 11-2 of the Code of the City of Sanford, Florida, per usage. (b) For any multiple residential use including but not limited to duplexes, apartments, quarters or combination thereof, a charge of two dollars and seventy-five cents ($2.75) per family dwelling unit, subject, however, to a minimum of five dollars and fifty cents ($5.50). Quarters occupancy is defined as several single family rental buildings of one ownership on the same premises and serviced as to other utilities through a single utility meter or bill. No more than two receptacles per family dwelling unit shall be allowed as provided by Section 11-12. (d) The monthly fees provided hereina'bove shall cover the uniform refuse collection service provided for all usages similarly situated throughout the City of Sanford. Upon application of the owner to the City Manager, or upon his own investigation, the City Manager is hereby vested with authority after consideration of the volume, type, specialty of handling, and required frequency of collection, to specially classify users as special refuse collection customers. These customers shall pay a refuse fee recommended by the City Manager and approved by the City Commission upon notification to the user as to such special classification and fee. Should any person feel aggrieved 'by an administrative ruling of the City Manager under and by virtue of this ordinance, such person may file a written complaint in duplicate with the City Clerk not later than twenty-four hours prior to a regularly scheduled meeting of the City Commission and set forth, briefly, the grievance complained of. The Clerk upon receipt of such complaint shall refer the same to the City Manager to be placed on the agenda for hearing at the next ensuing meeting of the City Commission."
