1121 ORDINANCE NO. 1121
AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
AMENDING ORDINANCE NO. 882, SAID A1VLEND1VLENT
PROVIDING CERTAIN NE~V REGULATIONS AND REQUIRE-
MENTS INVOLVING TAXICABS, THEIR OPERATION,
LICENSING AND FINANCIAL RESPONSIBILITY.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA:
SECTION 1. That Section 13 of Ordinance No. 882 of the City of
Sanford~ Florida, be and the same is hereby amended to read as follows:
"SECTION 13. Same--Assignment or transfer of
certificate.
No certificate may be sold, assigned, mortgaged, leased
or otherwise transferred without approval of the City Commission
and in accordance with all of the provisions of this chapter. Any
certificate which is not used for a period of three (3) months shall
be automatically revoked."
SECTION 2. That subsections (c) and (f) of Section 15 of Ordinance
No. 882° of the City of Sanford, Florida, be and the same are hereby amended
to read as follows:
"SECTION 15. Equipment and maintenance of vehicles.
(c) Periodic inspection. Every vehicle operating under
this chapter shall be periodically inspected at least every six months,
in accordance with the procedure herein established, to insure the
continued maintenance of safe operating conditions. All vehicles
operated as taxicabs which are more than two years old, including
the current year, shall be inspected quarterly. The exact dates for
making the semi-annual and quarterly inspections required by this
subsection shall be established by the Chief of Police.
(f) Inspection fee. An inspection fee for each vehicle inspected
under the provisions of this section shall be paid to the inspecting agency
conducting the inspection, which said inspection agency shall be approved
by the City of Sanford, Florida.
SECTION 3. That subsection (a) of Section 16 of Ordinance No. 882
of the City of Sanford, Florida° be and the same is hereby amended to read
as follows:
"SECTION 16. Schedule of fares,
(a) Fares shall be charged in accordance with the rates
designated in the various zones as set forth in the map of the City
of Sanford, Florida dated April 9, 1973, and referred to as
the Taxicab Rate Ordinance Map. The fare to be charged shall be
determined by the rate applicable to the zone which is the destination
of the passenger. It shall be unlawful for the operator of any taxicab
to charge or collect or attempt to charge or collect any fare which is
at variance with the rate schedule as set forth on the Taxicab Rate
Ordinance Map."
SECTION 4. That Section 17 of Ordinance No. 882 of the City of
SaD_ford, Florida, be and the same is hereby amended to read as follows:
"SECTION 17. Posting schedule of rates and name of
certificate holder.
There shall be painted on each front door of each licensed
taxicab in letters at least three inches in height and one-fourth
inch strokes, the name of the certificate holder under which such
taxicab is operated. In addition, there shall be posted in the
interior of the vehicle at all times in a position so as to be visible
to all passengers a notice that fares are charged in accordance with
the rate schedule as set forth on the Taxicab Rate Ordinance Map."
SECTION 5. That Section 18 of Ordinance No. 882 of the City of
Sanford, Florida, be and the same is hereby amended to read as follows:
"SECTION 18. Observance of fare schedule.
It shall be unlawful for the owner or driver of any licensed
taxicab for hire to refuse to convey a passenger at the fare specified
on the Taxicab Rate Ordinance Map or to demand or receive an
amount in excess of the fare schedule as referred to herein. Upon
demand a receipt for such fare shall be delivered to the passenger."
SECTION 6. That subsection (e) of Section 27 of Ordinance No. 882
of the City of Sanford, Florida, be and the same is hereby amended to read
as follows:
"SECTION 27. Chauffeur's permit.
(e) The City hereby reserve~ the right to suspend or
revoke any chauffeur's permit issued by the Chief of Police
upon investigation, the City Commission shall find that the
holder of such permit has violated any of the provisions of this
chapter, or has been convicted of a felony, in which case the
revocation shall be mandatory; or has been convicted of driving
any motor vehicle while under the influence of intoxicating liquors
or narcotics, or when such person is suffering from a communicable
disease or defect or impairment of vision or hearing, or other
physical impairment; or if such person is not a person of good moral
character and fitness, such permit may be revoked or suspended by
the City Commission; provided, that before my such permit shall be
revoked or suspended by the City Commission, notice of intention
~hereof shall be served upon such person eilher by United Sta~es
mail or personal service, and such person shall be given an
opportunity to be heard. The revocation or suspension of any
such permit by the City Commission shall be made only in cases
in which a person whose permit is to be suspended or revoked
shall be before the Commission and shall have had an opportunity
to be heard."
SECTION 6. That Section 30 of Ordinance No. 882 of the City of
Sanford, Florida, be and ~e same is hereby amended to read as follows:
"SECTION 30. All taxicabs l[censed and operated under this
ordinance shall be operated at least five days per week between the
hours of 7:00 A. M. and 900 P. M. All holders of more than
three licenses shall provide adequate taxicab service ~wenty-four
hours per day, seven days per week."
SECTION 7. Except as amended here in, said Ordinance as
amended shall remain in full force and effect.
SECTION 8. That ibis Ordinance shall become effective immedi-
ately upon its passage and adoption.
