AN ORDINANCE OF THE CITY OF SAN FORD, FLORIDA,
CLOSING, VACATING, AND ABANDONING ALL RIGHTS OF
WAY BETWEEN SCL RAILROAD, PERSIMMON AVENUE, rn
MCCRACKEN ROAD AND WEST 13TM STREET (EXCEPT
DIXIE WAY) IN THE CITY OF SANFORD, FLORIDA,
RESERVING A UTILITY EASEMENT OVER THE UNNAMED
EAST-WEST RIGHT OF WAY FROM DIXIE WAY WEST TO
THE SCL RAILROAD RIGHT OF WAY; PROVIDING FOR
SEVERABILITY, CONFLICTS AND EFFECTIVE DATE.
~ WHEREAS, an application has been filed with the City of Sanford to close, vacate
.- and abandon all rights of way between SCL Railroad, Persimmon Avenue, McCracken m

m Road and West 13th Street (except Dixie Way) in the City of Sanford, Florida, reserving a

· ,-;- utility easement over the unnamed east-west right of way from Dixie Way west to the SCL
,r-- Railroad right of way; and --

~ WHEREAS, a public hearing was held on July 23, 2001, for consideration and

m determination as to whether or not the closing, vacating and abandoning all rights of way

~ ~ between SCL Railroad, Persimmon Avenue, McCracken Road and West 13th Street ~-~
~ m (except Dixie Way) in the City of Sanford, Florida, should be allowed; and
~ WHEREAS, the City Commission has determined that the closing, vacating and

abandoning of that certain property does not conflict with the Comprehensive Plan of the
o City of S~,nford, Florida, and that the public health, economy, comfort, order, convenience,

~ and welfare will be promoted by such closing, vacating and abandoning.
~ NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF

c~ SECTION 1: That all rights of way between SCL Railroad, Persimmon Avenue,

~ McCracken Road and West 13th Street (except Dixie Way) in the City of Sanford, Florida,
more particularly described as follows:

be and the same is hereby closed, vacated, and abandoned; provided that the City shall
reserve a utility easement over the unnamed east-west right of way from Dixie Way west
to the SCL Railroad right of way.
SECTION 2: If any section or portion of a section of this ordinance proves to be
invalid, unlawful or unconstitutional, it shall not be held to impair the validity, force or effect
of any other section or pad of this ordinance.
SECTION 3: That all ordinances or pads of ordinances in conflict herewith be and
the same are hereby revoked.
SECTION 4: That this ordinance shall become effective immediately upon its
passage and adoption.
